Inspector’s narrative

What the inspector wrote

On 06/13/2025 at 9:05 AM, Licensing Program Analysts (LPAs) Christina Watts and Karina Canela conducted a Case Management Inspection at Kindercare Learning Center #1039. LPA's met with Assistant Director, Toria Chatman and explained the purpose of today's inspection. Director Selene Acosta was not present during today's inspection. During today's visit, there are 49 preschool children with 11 staff in 5 classrooms. Asst Director stated there are 62 preschool children enrolled. All staff caring and supervising children Criminal Record Clearance. LPAs are following up on a self reported incident. On 05/15/2025 around 11:45 AM/12:00 PM, interviews stated S1 was holding C1's hand to bring C1 to S3 to put a diaper on C1 before nap time. S2 stated they were talking to S4 when S1 slapped C1 in the face. Multiple staff interviews stated they heard C1 say "Oww". Multiple staff interviews stated they heard S1 say,"Oh be quiet. I didn't hit you that hard." Per California Code of Regulations, Title 22, staff are to treat children with dignity and respect and cannot slap a child at any time. During the investigation, staff interviews stated that S1 would leave children unsupervised when S1 would send a child to the restroom from outdoor play yard when S1 thought another staff member was inside to supervise the child. Staff interviews stated this has occurred about 2-4 times. Per California Code of Regulations, Title 22, children are to be supervised by staff at all times. Also, staff interviews stated that the staff informed the Director regarding S1 not taking the preschool children to the restroom and leaving the children unsupervised. Per California Code of Regulations, Title 22, The Director is required to report any unusual incidents that happened during hours of operation that threatens the physical or emotional health or safety of any child. Staff interviews also stated that S1 and S3 would yell and argue in front of daycare children. Interviews stated this has occurred around 2-5 times. *CON'T ON PAGE 2* *PAGE 2* Per California Code of Regulations, Title 22 states staff are to conduct themselves professionally and are not to yell and argue with staff in front of children. This facility is out of regulation in accordance to California Code of Regulations, Title 22. LPA Christina Watts informed Asst Director Toria Chatman that this report dated 06/13/2025 documents 2 Type A citations which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Furthermore, LPA Watts informed the Asst Director to provide a copy of this licensing report dated 06/13/2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. LPA Christina Watts informed Asst Director Toria Chatman that this report dated 06/13/2025 documents 2 Type B citations. Type B citation(s) are a potential risk(s) to the health, safety, or personal rights of children in care. *SEE LIC 809-D FOR DEFICIENCIES* Exit interview conducted and report was reviewed with the Assistant Director, Toria Chatman. A Notice of Site Visit was given and must remain posted for 30 consecutive days.

    101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. This requirement has not been met as evidenced by: Based on interviews, the licensee did not comply with the section cited above S1 and S3 were yelling and arguing in front of daycare children which poses an potential risk to the health, safety or personal rights of children in care.

  • PERSONAL RIGHTS

    101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain...or other actions of a punitive nature...This requirement has not been met as evidenced by: Based on interviews, the licensee did not comply with the section cited above when S1 slapped C1 in the face which poses an immediate risk to the health, safety or personal rights of children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time...Supervision shall include visual observation. This requirement has not been met as evidenced by: Based on interviews, the licensee did not comply with the section cited above when S1 let children go inside the classroom to use the restroom alone on 2-4 occassions which poses an immediate risk to the health, safety or personal rights of children in care.
