What the inspector wrote

On 04/16/2026 at 9:50 AM, Licensing Program Analyst (LPA) Christina Watts conducted an Case Management Inspection at Kindercare Learning Center #1039 regarding an alleged personal rights violation. LPA met with Assistant Director, Toria Chatman and explained the purpose of today's inspection. Director, Selene Acosta was not present during today's inspection. During today's inspection, there were 55 preschool children with 9 staff in 5 classrooms. Assistant Director stated there are 63 preschool children enrolled. LPA is following up on an self reported Unusual Incident Report submitted to licensing on 03/30/2026. LPA conducted interviews and obtained relevant documents. On 03/25/2026, per interviews, S1 was upset that they had to stay later after work and was unable to be relived on time. Per interviews, S1 was supervising and caring for 2 preschool children. Per interviews, C2 did not want to leave the classroom and started crying so S1 placed C2 over their shoulder while C1 walked with S1 to the Pre-K classroom. Per interviews, S2 and S3 were in the Pre-K when S1 came in with both C1 and C2. Per interviews, S1 placed C2 down and staff heard a loud "thump" as S1 placed C2 down. Per interviews, S1 then pushed C1 and C2 further inside the classroom. Per California code of Regulations, Title 22 states children are to be treated with dignity and respect as to not be placed over any staff shoulder nor pushed inside any area of the facility. Per documentation, the incident occurred on 03/25/2026 and the incident was reported to licensing on 03/30/2026. California code of Regulations, Title 22 states when a incident occurs during hours of operation, the facility has 24 from occurrence or knowledge of an occurrence to report the incident to licensing. This facility is out of compliance with California code of Regulations, Title 22. LPA Christina Watts informed Assistant Director, Toria Chatman that this report dated 04/16/2026 documents 2 Type B citations. Type B citation(s) are a potential risk(s) to the health, safety, or personal rights of children in care. *PAGE 2* LPA Christina Watts assessed a civil penalty of $250 for repeat violation of personal rights in accordance with the California Code of Regulations, Title 22. Exit interview conducted and report was reviewed with the Assistant Director, Toria Chatman. A Notice of Site Visit was given and must remain posted for 30 consecutive days.
