Inspector’s narrative

What the inspector wrote

On 01/10/2024 at 10:45 AM Licensing program analyst (LPA) Sikia Blue and Licensing program manager (LPM) Loretta Dyson arrived for an unannounced visit. LPA met with owner/director Ms.Farideh Bavafa and explained the purpose of today’s visit. During today’s visit the census is 27 children in care and 2 teachers. During the course of this investigation, we reviewed documents, made observations, and conducted interviews. Based on all information received it was confirmed, several witnesses stated the owner/director physically diciplined children. It was determined this incident was intentional and the director did physically discipline children in care at the facility which poses an immediate risk to the health and safety of children in care therefore, the above allegation is determined to be substantiated. California code of regulations Title 22, Division 12, Chapter 1, Article 6, section 101223(a)(3) is being cited on the attached LIC 9099d. Type A deficiency is being cited and a copy of the report needs to be posted for 30 days and given to parents of children who are currently enrolled and newly enrolled for the next 12 months. Exit interview was conducted, report was reviewed and given to licensee, notice of cite visit was given and licensee should post for 30 days, and appeal rights were given.

    The licensee shall ensure that each child is accorded the following personal rights:To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting.... This requirement was not met, based on interviews. It was confirmed several children were phyically disciplined by owner/director. This posed an immediate risk to the health and safety of children in care.
