TEACHER QUALIFICATIONS AND DUTIES

101216.1(g) A photocopy of the teacher's Child Development Permit as specified in (c)(3) above, or a photocopy of the teacher's transcript(s) documenting successful completion of required course work, shall be maintained at the center. This requirement was not met as evidenced by: LPA record review and observed one (1) staff member S1 supervising children alone without proof of qualifications on file at the facility. This poses a potential risk to the health and safety of the children in care.

TEACHER AIDE QUALIFICATIONS AND DUTIES

101216.2(e) An aide shall work only under the direct supervision of a teacher.This requirement was not met as evidenced by: Based on record review and observation, one (1) staff (S1) teacher aide was left alone without a qualified teacher with 2 infants in care. This poses a potential risk to the health and safety of the children in care.

Based on record review, the licensee did not comply with the section cited above in current infant staff did not have official documents to sthat being a fully qualified infant teacher upport which poses/posed a potential health, safety or personal rights risk to persons in care.

PERSONNEL REQUIREMENTS

Based on record review the licensee did not comply with the section cited above in director and staff did not have current CPR/First Aid which poses/posed a potential health, safety or personal rights risk to persons in care.

ARTICLE 2. Administration of Child Day Care Licensing

Based on record review, the licensee did not comply with the section cited above in both directre and staff mandated reporter training has expired, which poses/posed a potential health, safety or personal rights risk to persons in care.

STAFF-INFANT RATIO

There shall be a ratio of one teacher for every four infants in attendance. Based on interviews and record review, staff did not comply with the section cited above as an infant aide supervises infants alone, which posed a potential threat to the health and safety of the children in care.

INFANT CARE TEACHER QUALIFICATIONS AND DUTIES

Prior to employment, an infant care teacher shall have completed, with passing grades, at least three postsecondary semesters or equivalent quarter units in early childhood education or child development, and three postsecondary semester or equivalent quarter units related to the care of infants... Based on interviews and record review, staff did not comply with the section cited above as 1 staff does not have the units to be an infant teacher, which posed a potential threat to the health and safety of the children in care.

LIMITATIONS ON CAPACITY

A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. Based on interviews and record review, staff did not comply with the section cited above as staff are comingling the two programs, which posed a potential threat to the health and safety of the children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION FOR INFANTS

Based on observation, the licensee did not comply with the section cited above by not ensuring all children are not left without supervision at any time, which poses/posed a potential health, safety or personal rights risk to persons in care.

BUILDINGS AND GROUNDS

101238Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.This requirement was not met as evidence by: Based on observation the facility did not comply with section cited above by ensuring the carpets are clean, sanitary, and in good repair, which poses as a potential risk to health, safety, and personal rights of children in care.

Based on observation, interview, record review, the licensee did not comply with the section cited above by ensuring there is a fully qualified teacher in the classroom with infants, which poses/posed a potential health, safety or personal rights risk to persons in care.

INFANT CARE FOOD SERVICE

Based on observation, interview, record review, the licensee did not comply with the section cited above by not ensuring all infant's bottles and containers are labeled with the infant's name and current date, which poses/posed a potential health, safety or personal rights risk to persons in care.

OUTDOOR ACTIVITY SPACE

Based on observation the licensee did not comply with the section cited above by ensuring there is not a big hole in the wooden fence and wooden pieces on the ground that are accessible to children in care, which poses/posed a potential health, safety or personal rights risk to persons in care.

101217(a) Personnel Records. Personnel records shall be maintained on the licensee, administrator, and each employee, and shall contain specified information. This requirement was not met as evidenced by document review and licensee interview. Licensee states she does not have complete records for all of her employees. This poses a potential health risk to the health and safety of children in care.

Infant Care. A photocopy of each teacher's transcript(s) documenting successful completion of required course work shall be maintained at the center. This requirement was not met as evidenced by record review: LPA reviewed records and there were no transcripts of infant classes of the infant teacher.

101238 Buildings and Grounds. Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children. This requirement was not met as evidenced by observation: LPA observed an open gate to the kitchen and bleach in an unlocked cabinet; and a CD cord accessible. This was pointed out to the director. This poses a potential health risk to the health and safety of children in care.
