STAFFING RATIO AND CAPACITY

For a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home ... shall be either: Twelve children, no more than four of whom may be infants "This requirement is not met as evidenced by: Based on observation the Licensee left the home for a period of time and left ten children under the care of one assistant making the facility out of ratio which poses an immediate health and safety risk to persons in care.

PERSONNEL REQUIREMENTS

102416.5(b)(2)(e)(e)If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections..(b)(2) Six children, no more than three of whom may be infants; The requirement was not met......because licensee was not at the home and assistant was left alone with 9 children (3 infants and 7 preschool children), which put the facility out of ratio and this posed a potential risk of the health and safety of children in care.

Family Day Care Homes

Based on [(observation) (interview) (record review)], the licensee did not comply with the section cited above, LPA did not observe MMR immunization record for assistant working with children in care in the FCCH, which poses/posed a potential health, safety or personal rights risk to persons in care.

597.622 Employees or volunteers at family day care home; immunization requirements; records; exemptions.(a) (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year.
