What the inspector wrote

On 9/8/2025 at 9:05am Licensing Program Analyst (LPA) Morgan Pringle met with facility owners to deliver findings for a complaint. Present during LPAs visit were twenty-two (22) preschool age children, twelve (12) toddlers, and ten (10) additional staff. The facility operates from 7:00am – 6:00pm, Monday – Friday. During the course of LPAs investigation records were obtained for an incident that happened on 3/14/2025 where a Deputy from the Contra Costa County Sheriffs Department was called to the facility. The incident was not reported to the Department or the child’s family. The Department was informed by facility owners that they were instructed by the Deputy to not report the incident to the Department or the child’s parents. Through interview it was found that the child’s family was also told by the facility owners that the Deputy told the owners not to report the incident to the child’s parents. The Deputy’s body-worn camera video was reviewed from the day of the Deputy’s visit to the facility, and it was found that the Deputy did not instruct the facility owners to not report the incident to the Department or the child’s parents. Through interviews conducted during LPAs investigation, it was also found that in February 2025 a child sustained a concussion while in care. Two children bumped into each other while transitioning from inside to outside. The child was taken to the hospital where the concussion was confirmed by a physician. The incident was not reported to the Department or to the child’s parents. Continued on LIC809C Two (2) Type B citations are being issued during today visit. See LIC809D. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with owners.

    101212(d)(1)(B) Upon the occurrence...a report shall be made to the Department by telephone or fax within the Department's next working day...In addition, a written report containing the information ...shall be submitted to the Department within seven days following the occurrence of such event. (1) Events reported shall include the following: This requirement was not met as evidenced by: the Department was not notified of a child sustaining a concussion while in care in February 2025 which poses a potential risk to the health, safety and/or personal rights of children in care.

    1596.885(c) The department may... suspend or revoke any license...issued under this act upon any of the following grounds and in the manner provided in this act: (c) Conduct which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility...This requirement was not met as evidenced by: Owners were not truthful to the Department and child's family about Deputy's instructions which poses a potential risk to the health, safety and/or personal rights of children in care.
