(a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.This requirement is not met as evidenced by: Based on interviews and record review, it has been determined that a child sustained an amputation injury to their finger while playing with a basketball hoop net due to staff failing to provide adequate visual observation and supervision. This poses an immediate risk to the health, safety, and/or personal rights of children in care.

(1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test.This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above. On 07/31/2023, facility representative provided proof that the facility has their drinking and cooking water tested and have lead exceedance on multiple faucets. Facility representative stated that he is scheduling an appointment for the water to retest for lead level as the faucets have been replaced. During today’s inspection, Licensee failed to provide retest results for the building as the building was constructed before January 1, 2010. This poses a potential health, safety, or personal rights risk to children in care.

Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination... This requirement was not met as evidenced by a file review of staff files. Staff #1 did not have proof of immunization requirements. This posses a potential risk to the health, safety and/or personal rights of children in care.
