RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

(a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.This requirement is not met as evidenced by: Based on interviews and record review, it has been determined that a child sustained an amputation injury to their finger while playing with a basketball hoop net due to staff failing to provide adequate visual observation and supervision. This poses an immediate risk to the health, safety, and/or personal rights of children in care.

ARTICLE 3. Administration

Based on record review, the licensee did not comply with the section cited above. LPA observed that the facility completed water testing and results indicated that the drinking and cooking have exceedance the 5.5 ppb. Facility failed to remediating lead exceedance. This poses a potential health, safety, or personal rights risk to children in care.

(b) All child care centers shall have a director. This requirement is not met as evidenced by:Licensee failed to submit proof that Staff #1 meets the requirement as a Site Supervisor. Facility representative stated that Staff #1 just started her employment with this facility as Site Supervisor on 12/04/2023. This poses a potential health, safety, or personal rights risk to children in care.

ARTICLE 3. Administration

(1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test.This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above. On 07/31/2023, facility representative provided proof that the facility has their drinking and cooking water tested and have lead exceedance on multiple faucets. Facility representative stated that he is scheduling an appointment for the water to retest for lead level as the faucets have been replaced. During today’s inspection, Licensee failed to provide retest results for the building as the building was constructed before January 1, 2010. This poses a potential health, safety, or personal rights risk to children in care.

Based on record review, the licensee did not comply with the section cited above. Per Licensee Lead Testing will be conducted on 07/15/2023. Licensee failed to provide testing result for building as building was constructed before January 1, 2010, which poses a potential health, safety, or personal rights risk to persons in care.

ARTICLE 2. Administration of Child Day Care Licensing

Based on record review, the licensee did not comply with the section cited above. Staff 1, 2, and 3 had no current mandated reporter training which poses a potential health, safety or personal rights risk to persons in care.

ARTICLE 1. General Provisions and Definitions

Employees or volunteers at day care center; immunization requirements; records; exemptions. Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination... This requirement was not met as evidenced by a file review of staff files. Staff #1 did not have proof of immunization requirements. This posses a potential risk to the health, safety and/or personal rights of children in care.

Personnel Records. Personnel records shall be maintained on the licensee, administrator, and each employee, and shall contain specified information. A health screening as specified in Section 101216(g). This requirement was not met as evidenced by inspection. Health screening for staff #1 was missing from file. This poses a potential risk to the health, safety, or personal rights of children in care.

PERSONNEL REQUIREMENTS

At least one person trained in CPR and Pediatric First Aid shall bepresent when children are at the facility or at offsite activities. This requirement was not met as evidenced by this inspection. Staff's CPR/1st Aid expired on 05/20/21. This posses a potential risk to the health, safety and/or personal rights of children in care.

Mandated Reporter Training - On or before March 30, 2018..is a licensed child care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training...shall complete renewal mandated reporter training every two years..the initial mandated reporter training. This requirement was not met as evidenced by: file review of staff files. A copy of an approved Mandated Reporter Training Certificate for staff #1 was not in file. This posses a potential risk to the health, safety and/or personal rights of children in care.

Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children. (1) Storage areas for poisons shall be locked. This requirement was not met as evidenced by LPAs inspection. Clorox Bleach, Lysol, Ajax and other cleaning supplies stored in a cabinet underneath the handwashing sink in Classroom #3-4. This posses a potential risk to the health, safety and/or personal rights of children in care.
