Based on observation, the licensee did not comply with the section cited above in that LPA observed various stains on the walls, various boxes and items stacked upon each other on top of the preschool and toddler classroom's cubbies, and toddler rug held various dark stains, which poses/posed a potential health, safety or personal rights risk to persons in care.

101238 Buildings and Grounds(a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. Based on observation, the facility did not comply with the section cited above. In that LPA observed that one toliet out of three leaked water when flushed in the girls restroom, which poses a potential health, safety or personal rights risk to persons in care.

LPA observed that Staff 1 missing immunization record TDAP,MMR, and Flu. Staff 2 missing flu. Which poses a potential health, safety or personal rights risk to persons in care.

ARTICLE 2. Administration of Child Day Care Licensing

HSC1596.8662(b)(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs.....This requirement is not met as evidenced by: Based on record review, the Administrator did not comply with the section cited above. LPA observed that Staff 1, and Staff 2 do not have a current mandated reporter on file.Which poses a potential health, safety or personal rights risk to persons in care.

FOOD SERVICE

All food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. All food shall be selected, stored, prepared and served in a safe and healthful manner. This requirement was not met as evidenced by the LPA observations, further discussed on the 9099 report. This is a possible risk to the health, safety or personal rights of children in care.

ARTICLE 2. Administration of Child Day Care Licensing

Based on record review, the Administrator did not comply with the section cited above. LPA observed that Staff #1 did not observe a current complete the Mandated Reporter training, which poses a potential health, safety or personal rights risk to persons in care.

Based on observation and interview, the licensee did not comply with the section cited above. Staff #1 stated they were are unable to provide LPAs children and staff records due to records being locked in cabinet and only available to Director via key. LPAs were unable to review records which poses a potential health, safety, or personal rights risk to persons in care.

Based on observation and interview, the licensee did not comply with the section cited above. Upon arrival LPAs met with Staff #1 who stated they was currently the person in charge. Both Director and Assistant Director were not present. LPAs were unable to review Designation of Facility Responsibility (LIC 308) and other documentation to verify that staff #1 is designatined to act on the Director's absence. This poses a potential health, safety or personal rights risk to persons in care.
