What the inspector wrote

Through interviews with staff and board member as well as video footage of cameras inside the classroom LPM McWilliams was able to verify that staff #1 (S1) talked to children in an inappropriate manner. Based on LPM McWilliams interviews that were conducted and camera footage viewed, the preponderance of evidence has been met that staff left children unattended as punishment and staff spoke inappropriately to day care children that would result in an immediate personal rights violation to children in care, therefore the above allegation is found to be SUBSTANTIATED. Through classroom observation during multiple inspections and video footage obtained from the cameras in the classrooms LPM McWilliams was able to observe staff not appropriately supervising children at all times. Based on the evidence presented the preponderance of evidence has been met that children were not appropriately supervised at all times which would result in an lack of supervision violation, therefore the above allegation is found to be SUBSTANTIATED. Through interviews conducted and observation of video footage LPM McWilliams was able to confirm that staff handled children in a rough manner on multiple occurrences. The preponderance of evidence has been met that staff handled day care children in a rough manner that would result in an immediate personal rights violation to children in care, therefore the above allegation is found to be SUBSTANTIATED. Exit interview conducted and report was reviewed with Director Talar Hovagimian and Principal Nayree Shishmanian. Appeal rights were provided. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiencies are being cited: (see next page). Upon receipt of a Type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports was given to Licensee. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days. Due to the inability to gather enough evidence the preponderance of evidence was not met, however LPM McWilliams was unable to prove that the temperature was in regulation therefore although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. Exit interview conducted and report was reviewed with Director Talar Hovagimian and Principal Nyree Shishmanian. Appeal rights were provided. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, no deficiencies are cited. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.

  • PERSONAL RIGHTS

    (a) The licensee shall ensure that each child is accorded the following personal rights:(3) To be free from corporal or unusual punishment... humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions... This requirement was not met as evidence by children were left in time out in a classroom by themselves and staff # 1 (S1) was observed speaking innapropriately to and roughly grabbing children in care, which are immeidate threats to the health and safety or personal rights to children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    (a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by staff not supervising preschool children in restrooms and leaving children in back classroom while all staff are in the front classroom, which poses a possible threat the the health and safety or personal rights to children in care.
