What the inspector wrote

On April 2, 2025, Licensing Program Analyst Miguel Herrera conducted an unannounced Case Management Inspection. LPA met with Director, Beth Nelson and Assistant Director, Vivian Hernandez. LPA toured the facility, and a census was taken. The purpose of today's inspection was regarding an Unusual Incident that was self reported by the facility to the Fresno Childcare Regional Office, the incident occurred on 03/28/2025, the incident was regarding a violation of a child’s personal rights. During today’s visit LPA Herrera conducted facility observations, reviewed records and interviewed staff to gather further information pertinent to the incident. Through interviews conducted and documentation reviewed, it was confirmed that staff #1 inappropriately handled child #1 by lifting the child by the wrist while the child was resisting and upset. Through interviews, it was disclosed that child #1 was observed getting into another child's personal space, however child #1 was not a danger to themselves or others in the classroom, therefore LPA determined that staff #1’s actions were not merited. Through interviews and records review, it was determined that the incident was an isolated incident. Although the facility followed appropriate reporting requirements and took appropriate measures to address the incident, staff #1’s actions violated child #1’s personal rights and posed an immediate risk to children in care (see LIC 809-D Type A deficiency). Exit interview conducted and report was reviewed with Director Beth Nelson. Appeal rights were provided. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiency is being cited: (see LIC. 809-D). Upon receipt of a Type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports was given to Director, Beth Nelson. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.
