Based on observations, statements and records review, the licensee did not comply with the section cited above as adult #1 was determined to live in the home without a criminal record clearance. LPA Herrera observed adult #1 doing her hair and make up and licensee disclosed that adult #1 was residing in the home and identified as her adult daughter, which poses an immediate health, safety or personal rights risk to persons in care.

This requirement was not met as evidenced by: Based on the interview with the licensee and as confirmed by law enforcement reports, there was a verbal and physical altercation in the home during daycare hours, when children were in care. This poses a potential risk to the health, safety, or personal rights of children.
