What the inspector wrote

On April 11, 2022 , at 11:00 a.m. , Licensing Program Analyst (LPA), Gloria Gonzalez conducted an unannounced Annual Required Inspection and met with the Licensee, Aurelia Mariscal .\302\240 LPA disclosed the purpose of the inspection and was granted entry into the facility by the Licensee. Four (4) daycare children and one (1) staff were present in the facility during this inspection. This facility is a one story, 4 bedrooms, 5 bathroom house . Licensee accompanied LPA inside and out of the facility during this inspection. Licensee states the garage was converted to a bedroom #4 and bathroom #4 not for daycare use. The following areas used for child care are: living room, bathroom #5, kitchen, dining room, den, and backyard .\302\240 Off limits areas are bedrooms #1, #2, #3, #4, bathrooms #1, #2, #3, #4, and are inaccessible through use of door locks . Hours of operation are: Monday-Friday from 6:00 am to 9:00 pm. The fire extinguisher, smoke detector, and carbon monoxide detector met requirements.\302\240 Hazardous items were made inaccessible to children during the inspection. The licensee has toys, play equipment and materials available.\302\240 The home has a fenced backyard available for outdoor activities at time of inspection. No bodies of water observed on the premises during the inspection. Licensee stated there are no weapons in the home. A review of staff records on this date indicates that not all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions . Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home.\302\240 A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. Licensee\342\200\231s First Aid and CPR certification expires on 5/2023 .\302\240 Licensee has required immunizations.\302\240 Licensee completed Mandated Reporter Training on 2/23/21 . Facility roster is maintained and was reviewed.\302\240 The last fire and disaster drills were conducted and documented on 1/5/22. Licensee was advised if there is to be an infant in care, there must be is one crib or play yard for each infant who is unable to climb out of the crib or play yard. Cribs or play yards are free from all loose articles and objects. Licensee physically checks on sleeping infants up to 24 months of age every 15 minutes. An Individual Infant Sleeping Plan [LIC 9227 (3/20)] is maintained for each infant up to 12 months of age. Licensee places infants up to 12 months of age on their backs for sleeping. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA provided and discussed the following:\302\240 Report suspected child abuse and neglect, maintain children\342\200\231s records according to regulation, post all required forms.\302\240 Licensee was reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers and/or similar equipment are not allowed in daycare.\302\240 Licensee was also provided information regarding SIDS, Lead exposure and Shaken Baby Syndrome.\302\240 LPA and Licensee discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov . LPA advised if there is an unusual incident to report to call Licensing within 24 hours and to follow up with an LIC624B within 7 days. LPA discussed and provided Licensee with the following: child care advocates email address: childcareadvocatesprogram@dss.ca.gov . Incidental Medical Services (IMS) policy was discussed. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm Deficiencies are being cited based on LPA observation in accordance with the California Code of regulations, Title 22, violations regarding that two individuals living in the off limit room of the facility were not fingerprint cleared see LIC809D.\302\240 An exit interview was conducted. Plans of Corrections were reviewed and developed with the Licensee.\302\240 A Copy of this report and appeal rights were discussed and left with the Licensee, Aurelia Mariscal.
