conducted an unannounced
Annual Required
Inspection and met with the
Licensee, Rosario Jaimes
.\302\240 LPA disclosed the purpose of the inspection and was granted entry into the facility by the Licensee.
Four (4) daycare
children (1 infant, 1 school age, and 2 toddlers) and
no staff were present in the facility during this inspection. This facility is a
one
story,
four
bedroom,
three
bathroom
house
. Licensee accompanied LPA inside and out of the facility during this inspection. The following areas used for child care are:
kitchen, living room, dining room, hallway bathroom, bedroom 4 (daycare room), snack area, daycare area, front patio
.\302\240 Off limits areas are
: master bedroom, master bathroom
, bedroom 2 and 3,
and are made inaccessible through use of
door knob covers
. Hours of operation are: Monday- Saturday from 6:00am-10:30pm.
The fire extinguisher, smoke detector, and carbon monoxide detector met requirements.\302\240 Hazardous items were made inaccessible to children during the inspection. The licensee has toys, play equipment and materials available.\302\240 The home has a
fenced front yard
available for outdoor activities at time of inspection. No bodies of water observed on the premises during the inspection.
Licensee stated there are no weapons in the home.
A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances
.\302\240 Licensee
was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home.\302\240 A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

.\302\240 Licensee has required immunization's.\302\240Licensee completed Mandated Reporter Training on
10/30/2020\302\240 Facility roster is maintained and was reviewed.\302\240The last fire and disaster drills were conducted and documented on 5/12/22.
There is one crib or play yard for each infant who is unable to climb out of the crib or play yard.\302\240 Cribs or play yards are free from all loose articles and objects. Licensee physically checks on sleeping infants up to 24 months of age every 15 minutes.\302\240 An Individual Infant Sleeping Plan [LIC 9227 (3/20)] shall be maintained for each infant up to 12 months of age.\302\240 Licensee places infants up to 12 months of age on their backs for sleeping. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at
https://www.cpsc.gov/
and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.
LPA provided and discussed the following:\302\240 Report suspected child abuse and neglect, maintain children\342\200\231s records according to regulation, post all required forms.\302\240 Licensee was reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers and/or similar equipment are not allowed in daycare.\302\240 Licensee was also provided information regarding SIDS, Lead exposure and Shaken Baby Syndrome.\302\240 LPA and Licensee discussed California Megan's Law and LPA provided:

LPA advised if there is an unusual incident to report to call Licensing within 24 hours and to follow up with an LIC624B within 7 days. In addition, for general questions, questions regarding licensing requirements call Child Care Licensing.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. On 5/10/22 the department received an UIR that could have been a possible supervision violation. LPA followed up on this self-reported incident that occurred on 4/25/22. Licensee stated Child 1 (C1) threw the ball over the fence and Child 2 (C2) opened the gate to get the ball, when it happened the second time C2 opened the gate and C1 put her hand on the gate where it closes the gate. C1's thumb was smashed in between the gate door and the fence. Parent of C1 called licensee to advise that C1 thumb was fractured. At the time of this inspection, LPA spoke to C2 and stated he opened the gate to get the ball and when he closed the door C1 put her hand at the gate door where it closes and smashed her finger. C2 states it was an accident and states that Licensee was in the daycare area getting and infant with the door open. LPA observed the area where the ball was thrown and observed it is still in the Licensees yard that is gated with another gate. Children were not in danger of going to the street. C1 no longer attends the facility, her last day was 5/2/22. Licensee states parent did not give a reason, but Licensee assumes it could have been due to this incident.

A copy of the report and appeal rights (LIC 9058) was provided to the applicant and notice of site visit (LIC9213) was given to Licensee and must remain posted for 30 days.
LPA interpreted and explained the inspection report to licensee, licensee stated she understood.
An exit interview conducted and report was reviewed with the licensee, Rosario Jaimes
