What the inspector wrote

On 11/16/2023, Licensing Program Analyst (LPA) Ocegueda, conducted a case management inspection at the facility. LPA met with licensee Marcela Chavez, toured the facility and took a census. The purpose of this inspection was to discuss criminal record clearance. LPA conducted multiple interviews with current day care parents and children for the purpose of investigating a complaint investigation that was initiated on 10/4/2023 (see 9099 report dated 11/16/2023 for further details). Today, LPA explained to the licensee that at times, complaint investigations lead to unrelated discoveries that must be addressed. Through the interview process, it was discovered that there is an uncleared adult (adult #1) that is in the regular presence of day care children and assisting in caring/supervising of day care children in the licensee’s secondary business (a store in Shafter, CA) and in adult #1’s home. Multiple parents confirmed that their children go to adults #1 home and that adult #1 helps supervise the children in his/her home. Interviews revealed that children have attended the store and the home on multiple occasions and that it’s a regular occurrence during the typical week. Today, a $500.00 civil penalty was assessed (see 809-D). Today, LPA discussed that while the children are in her care, it is licensees’ responsibility to ensure that children are only being cared for by assistants that have a required criminal record clearance and that she is to adhere to all other Department and Title 22 regulation requirements. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are being cited: (see next page, 809 D) Licensee was provided a copy of appeal rights. Upon receipt of a Type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of LIC 9224 was given to licensee. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.

    Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (2) To receive safe, healthful, and comfortable accommodations….This requirement was not met as evidenced by: interviews. It was determined that licensee is providing care to children at her store in Shafter, CA and also at the home (unknown location) of adult #1 which is not licensed. This poses an immediatel risk to the health, safety and/or personal rights of children in care.

  • CRIMINAL RECORD CLEARANCE

    (d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department…This requirement was not met as evidenced by: Interview. Multiple individuals that were interviewed reported that daycare children have received care by adult #1 during licensees noted daycare hours and in the home of adult #1 who does not have a criminal record clearance on at least three occasions in the last month. This poses an immediate risk to the health, safety and/or personal rights of children in care. A $500.00 civil penalty was assessed today.
