What the inspector wrote

On 08/20/25, Licensing Program Analyst (LPA) Denisia Jimenez and Licensing Program Manager (LPM) Scott Herring arrived at the facility to conduct an unannounced Case Management Deficiencies inspection. LPA and LPM met with Director, Cheyenne Raths and Owner, Laurae Raths. LPA and LPM toured the facility, and a census was taken. It has been determined that facility staff engage in a concerning pattern of behavior involving the use of physical guidance and punitive discipline. Specifically, staff have been observed routinely pulling children by their wrists or forearms and using threats of placement in time out chairs as a disciplinary measure in response to maladaptive behaviors. These time out chairs are reportedly used not as tools for regulation or redirection, but rather as a means to label and punish children. Additionally, it was determined that Staff #2 observed Child #1 and Child #2 engaged in physical fighting and rough housing in her presence. Rather than intervening or redirecting the children to prevent escalation, Staff #2 failed to act and allowed the altercation to continue. This lack of supervision may have contributed to one of the children sustaining a physical injury, including but not limited to visible bleeding in the facial area. As a result, staff failed to provide adequate supervision, placing children at immediate risk of harm. These findings reflect violations of both personal rights and basic supervision standards required in a licensed child care setting. Per California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiencies Type A are being cited (see 809-D) Exit interview conducted report and appeal rights was reviewed with Owner/Director Laurae and Cheyenne Raths. These incidents pose an immediate risk to the health, safety, or personal rights to children in care in that inapproprioate physical contact was demonstrated and used by staff #1 to child #1 and child #2..

    (a)The licensee shall ensure that each child is accorded with the following personal rights:(1) To be accorded dignity....This requirement was not met as evidenced by:Staff #1 yelled at Child #2 while attempting to enforce a time-out, repeatedly raising her voice and demanding that the child sit down. Staff #1 was also observed yelling at children on multiple occasions which poses an immediate risk to the health, safety, or personal rights to children in care.

    Discipline(a)Any form of discipline or punishment that violates a child's personal rights....This requirement was not met as evidenced by: It is determined that chairs are used not as tools for regulation or redirection, but rather to threaten, demean, label and physically punish children for exhibiting maladaptive behaviors. This poses an immediate risk to the health, safety and/or personal rights of children in care in that the use of “time-out” is to be used appropriately in accordance to the dignity of children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229 Responsibility for Providing Care and Supervision(a)The licensee shall provide care and supervision as necessary to meet the children's needs (1) No child(ren) shall be left without the supervision…...This requirement was not met as evidenced by:Staff #1 and Staff #2 observed Child #1 and Child #2 rough housing in the classroom. Despite being instructed to stop, the children continued to engage in physical fighting in which staff neglected to intervene which resulted in child #1 sustaining minor physical injuries in the facial area. This is an immediate safety risk to children in care.
