101223 Personal Rights (7) Not to be placed in any restraining device. Postural supports may be used as specified in Section 101223.1.This requirement was not met as evidenced by: Based on records reviewed and interviews, Staff inappropriately restrained children in the mealtime chairs with a seatbelt for timeouts and to control children’s behaviors, which poses an immediate risk to the health, safety, or personal rights to children in care.

HEALTH-RELATED SERVICES

101226 Health-Related Services(a) The licensee shall immediately notify the child's authorized representative if the child becomes ill or sustains an injury ...This requirement was not met as evidenced by: Based on records reviewed and interviews, facility staff did not immediately notify the child’s authorized representative when child’s eyes were sprayed with bleach, which poses a potential risk to the health, safety, or personal rights to children in care.

101223 Personal Rights (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement was not met as evidenced by: Based on records reviewed and interviews, Child 4 received medical treatment due to Child 1 had accessed to the bleach and sprayed bleach at Child 4, which poses an immediate risk to the health, safety, or personal rights to children in care.

101538.3 Indoor Activity Space for School-Age Children (b) In combination programs, indoor activity space provided for school-age child care center children shall be physically separated from space provided for infant care and child care center children.This requirement was not met as evidenced by: Based on interviews conducted, at 6:00 a.m.-7:00 a.m. and at 5:30 p.m.-6:00 p.m. the preschool children and school age children were commingled, which poses a potential risk to the health, safety, or personal rights to children in care.

"(a)The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including..." This requirement was not met as evidenced by: Based on interview and document review, facility did not ensure Child #1's personal rights were not violated in that Teacher #1 slapped Child #1. This posed a potential risk to the health, safety, and personal rights of children in care.

ARTICLE 2. Administration of Child Day Care Licensing
