What the inspector wrote

On 08/27/24, Licensing Program Manager (LPM) Scott Herring, Licensing Program Analysts (LPA) Denisia Jimenez and Lady Cabrera met with Owner Laurae and Cheyenne Raths for an Informal meeting at the Fresno Regional Childcare Office. The purpose of today’s informal meeting was to discuss previous & recent violations of Title 22 Regulations pertaining to Children's personal rights being violated and commingling preschool and school age children for the school age license. LPM Herring reviewed and discussed the following with Laurae and Cheyenne Raths, and how the Childcare Center will maintain compliance with the deficiencies cited below. The Department of Social Services, Community Care Licensing Division has determined that Little Feet Childcare & Preschool Inc. Center violated the following Title 22 licensing regulations: On 02/26/24, LPA Cabrera issued a Type A deficiency for violation of California Code of Regulations Title 22 Division 12 Section 101223(a)(2), which states: (a)The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful, and comfortable accommodations, furnishings, and equipment to meet his/her needs. It was determined that Child #1 sprayed Child #4 with bleach and had to seek medical attention. On 02/26/24, LPA Cabrera issued a Type A deficiency for violation of California Code of Regulations Title 22 Division 12 Section 101223(a)(7), which states: Not to be placed in any restraining device. Postural supports may be used as specified in Section 101223.1. During record review and interviews, Staff inappropriately restrained children in the mealtime chairs with a seat belt for time-outs and to control children’s behaviors. On 02/26/24, LPA Cabrera issued a Type A deficiency for violation of California Code of Regulations Title 22 Division 12 Section 101238.4(g), which states: Storage Space (g) Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children. Based on records reviewed and interviews, Staff did not prevent Child 1 to have access to cleaning product. (Continued on 809-C) On 02/26/24, LPA Cabrera issued a Type B deficiency for violation of California Code of Regulations Title 22 Division 12 Section 101226(a), which states: Health related Services(a) The licensee shall immediately notify the child's authorized representative if the child becomes ill or sustains an injury. Based on records reviewed and interviews, facility staff did not immediately notify the child’s authorized representative when child’s eyes were sprayed with bleach. On 02/26/24, LPA Cabrera issued a Type B deficiency for violation of California Code of Regulations Title 22 Division 12 Section 10458.3(b), which states: Indoor Activity Space for school-age Children (b) In combination programs, indoor activity space provided for school-age childcare center children shall be physically separated from space provided for infant care and childcare center children. Based on interviews conducted, at 6:00 a.m.-7:00 a.m. and at 5:30 p.m.-6:00 p.m. the preschool children and school age children were commingled. The Director has submitted a plan of correction evidence for the above stated deficiencies. The above deficiencies were reviewed and discussed during today’s informal meeting. The Director retrained staff on personal rights regulations and had all staff sign the training verification form on 03/08/24. The facility has implemented plans of correction for the rest of the mentioned deficiencies as well. COMPLIANCE PLAN In response to these discussions, Licensee has agreed to the following: 1 . The Director agrees to comply with Title 22, Division 12, Chapter 1 of the California Code of regulations. 2. The Director submitted a training outline to Community Care Licensing Division and training attended by staff indicating how the Center will comply with personal rights of a child on 03/08/24. 4. Community Care Licensing will increase frequency of site visits for the next 24 months to the facility to monitor compliance. 5. The Director will ensure children are provided with a safe and healthful environment, and comfortable accommodations furnishing, and equipment at all times. 6. The Director agrees to be referred to the (TSP) Technical Support Program. 7 . Obtain and receive community training supports and resources pertaining to understanding and working with children with intellectual disorders. 8. Obtain and receive community training supports and resources pertaining to understanding and working with children that exhibit difficult and challenging behaviors. In addition, it was recommended that the licensee connect with her local resource and referral agency for additional support and training. LPA provided the licensee with resource and referral agency phone number. (Continued on 809-C) Today, Laurae was informed that any further repeats of the above deficiencies will result in a Non-Compliance Conference and possible referral to the Legal Division for possible Administrative Action. Furthermore, Laurae understands that any repeats of the above deficiencies within a 12-month period will result in the issuance of civil penalties. On 03/05/24 Owner Laurae and Director Cheyenne Raths requested a waiver to commingle school age children with preschool/toddler children. LPM has denied this request. A copy of this report was given to the Owner, Laurae Raths. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, No Deficiencies are cited during today’s Office Visit.
