Inspector’s narrative

What the inspector wrote

An inspection was conducted at the facility by Licensing Program Analysts, Sebastian Phouthavong. LPA met with Licensee, Michelle McBrayer. During the inspection the home was toured inside and outside. The licensee was supervising five daycare children and operating within the licensed capacity and ratio requirements. From an interview, Licensee and one staff admitted that an incident involving adequate supervision and the absence of a child occurred and did not notify Community Care Licensing (CCL) as required. Licensee further stated she did not submit a written Unusual Incident Report to the CCL as well. The following violation(s) of the California Code of Regulations, Title 22; Division 12, were observed: see LIC 809D. Appeal Rights were provided. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the licensee, Michelle McBrayer.

This requirement is not met as evidenced by: Based on the Licensee and one staff interviews, one daycare child eloped from the facility and found with a neighborhood resident. This poses an immediate health and safety risk to children in care. A civil penalty of $500 is being issued for absence of supervision.

    102416.2(b)(3)(C) Reporting Requirements: "A report shall be made to the Department…following the occurrence of.... (C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child." This requirement is not met as evidenced by: Based on an interviews, Licensee did not notify and/or submit a UIR to CCL. This posed a potential health, safety and/or personal rights risk to children in care.
