What the inspector wrote

Three Children were interviewed on 11/14/25, C1 - C3 confirmed that staff S1 had handled children in care in a rough manner, by grabbing the children by the arm aggressively and that it hurt the children\342\200\231s arm. C3 stated that S1 had whacked C3 on the butt. C1 stated that staff S3 had also grabbed children aggressively by the arms. C1 \342\200\223 C3 Confirmed that S1 and S3 had yelled at the children in care and that it had upset or scared the children but did not have any knowledge of staff S2 yelling. C1 \342\200\223 C3 did not have any knowledge on the temperature of the facility. Two staff (S1 \342\200\223 S2) were interviewed on 11/25/25 and 12/2/25 and Staff (S1 \342\200\223 S2) denied that S1 had ever handled children in a rough manner. (S1 \342\200\223 S2) denied that that S1 or S2 had ever yelled or threatened children in care. S1 confirmed that S1 was concerned about the temperature of the classroom during the summer and that it would get up to 89 degrees F in the summer. Four Parents (P1 \342\200\223 P4) were interviewed on 11/04/25 and 11/25/25 and stated P1 \342\200\223 P4 had no knowledge of Staff S1 handling children in a rough manner. P1 \342\200\223 P4 had no knowledge of staff S1 and S2 not treating children with respect or yelling and threatening children in care. P1 \342\200\223 P4 stated that the facility does get very hot during the summer months but could not confirm the exact temperature the facility reaches. On 09/05/25 LPA did observe portbale AC units and fans in the facility that were not in use, the temperature was a being maintained at a comfortable temperature on 09/05/25 During the investigation LPA conducted interviews with the Licensee, parents, staff and children that supported the allegations. Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D. LPA Sims informed licensee Pamela Lee that this report dated 12/2/25 documents two Type A citation(s) which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA Sims informed the licensee to provide a copy of this licensing report dated 12/2/25 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and report was reviewed with the licensee Pamela Lee. Appeal rights were provided. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

  • FIXTURES, FURNITURE, EQUIPMENT AND SUPPLIES

    (a) A comfortable temperature for children shall be maintained at all times.(1) The licensee shall maintain the temperature in rooms that children occupy... a maximum of 85 degrees F (30 degrees C)This requirement was not met as evidenced by: Based on interviews the licensee did not comply with the section cited above in by not maintaining a comfortable temperature in the facility which poses a potential, safety or personal rights risk to children in care.
