Inspector’s narrative

What the inspector wrote

2) Reporting Party (RP) alleged: Staff did not provide adequate supervision leading to a child sustaining an injury. Per RP, a child was inadequately supervised on the playground which led to a child falling and sustaining injury. Interviews were conducted with Staff 1 (S1) to Staff 5 (S5). Of the 5 Staff interviewed, 1 Staff member was able to corroborate the allegation indicating that they witnessed a Staff member not providing supervision to a child which led to a fall. LPA reviewed facility report (date 11/22) which documented the fall and that ice was applied to the injured area. 3) Reporting Party (RP) alleged: Staff left day-care children unattended in a classroom. Per RP, children are being left alone and unattended in the classrooms. Interviews were conducted with Staff 1 (S1) to Staff 5 (S5). Of the 5 Staff interviewed, 2 Staff members were able to corroborate the allegation indicating a child was left unattended in the classroom. Per Staff 2, Child 2 was told to gather their belonging in preparation for leaving the facility for the day. Child 2 proceeded to walk to obtain their personal belongings alone. Staff 5 encountered and witnessed Child 2 alone while gathering their belongings. Based on interviews conducted and record review, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. The facility is being cited on three Type A deficiencies in accordance with California Code of Regulations, Title 22, Division 12, Chapter 1, Article 01, Section 101223(a)(3), Section 101229(a) and Section 101229(a)(1). Definitions are being cited on the attached LIC 9099D pages. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). Acknowledgement of Receipt (LIC 9224 form) must be maintained in each child’s file immediately upon receipt from parents. An exit interview was conducted and a copy of this report was provided to Director Sandra Wong along with Appeal Rights. A Notice of Site Visit was provided, Notice of Site Visit must be posted for 30 days. page 2 of 2.

Of the 5 Staff interviewed, 2 Staff members were able to corroborate the allegation indicating they witnessed Staff 6 pull the arm of a child in a rough manner while in the outdoor play area.

    101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. This requirement is not met as evidenced by: Interviews were conducted with Staff 1 (S1) to Staff 5 (S5). Of the 5 Staff interviewed, 1 Staff member was able to corroborate the allegation indicating that they witnessed a Staff member not providing supervision to a child which led to a fall. Child 2 proceeded to walk to obtain their personal belongings alone. Staff 5 encountered and witnessed Child 2 alone while gathering their belongings.
