What the inspector wrote

Licensing Program Analysts (LPAs) Jeanette Estrada and Christine Nolan conducted an unannounced required annual inspection at the above facility. LPAs met with Licensee Lee Colbert and informed her of the purpose for the visit. LPA provided Licensee with a copy of the Facility Entrance Checklist. During this inspection, there were 3 children and two assistants present. All residents were noted and verified. All criminal record clearances for adults present were verified. Licensee Hyacinth Colbert was not present during the inspection. Facility provides care to children ages 6 months to 12 years old. The facility operates Monday through Friday from 6 AM to 6 PM. This is a one story 3 bedroom, 2 bathroom home with a living room, dining area, kitchen, enclosed backyard and garage converted to play room. Per Licensee areas on limits to children are: The living room, garage converted to playroom, one bedroom used for napping, hallway bathroom, dining area and enclosed backyard. Areas off limits to children: Two bedrooms, one bathroom and the pool area. All areas that are accessible to children were inspected for safety, comfort, and cleanliness. The following was observed and reviewed during this inspection: LPA observed required posted documentation- Facility license, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form, LIC 9040 Facility Roster. Licensee had a current copy of the facility roster and the last documented disaster drill was conducted on 5/8/25. There is an operable smoke detector and an operable carbon monoxide detector in the facility. Page 2 LPAs observed two 2A10BC Fire Extinguishers in the facility which were not serviced. Ventilation is provided via an A/C unit in the living room and portable fans. There is one screened heater in the living room. LPAs also observed a screened fire place in the living room. The home maintains telephone service (cell phone). Food is provided by Licensee. Licensee was reminded if children bring food from home it must be labeled with the child\342\200\231s name and properly stored or refrigerated. There are toys and other age appropriate materials available for children to use in the day care areas. Sharp objects, detergents and cleaning compounds in the kitchen were inaccessible to children in care. Knives are kept in a kitchen cabinet. Cleaning compounds are kept in a latched cabinet under the kitchen sink and in a latched upper cabinet in the hallway. There is a safety gate installed to prevent access to the kitchen from the living room. LPAs observed a washer and dryer in the garage/play room. Per Licensee, these items are not used while children are in care. Laundry detergent is kept inaccessible in an upper cabinet. Per Licensee, none of the children enrolled require medication at the facility and personal medication is kept in an off limits bedroom. Children use the bathroom in the hallway. LPAs observed potty training equipment in the bathroom. Per facility representative, children are escorted and supervised while using the restroom. LPA did not observe any hazardous items in the bathroom. Children use the backyard for outdoor play. The children access the backyard through the garage/playroom. The backyard is separated into two areas. There is a gate separating the on limits section from the off limits pool section. Per Licensee, children are supervised while playing outside. LPAs observed toys and equipment available in the back yard. LPAs inspected the pool area. Currently there is a waiver on file for the pool at this facility. LPAs reviewed requirements for the waiver. The pool is surrounded by a fence. The gate accessing the pool swings towards the pool and a padlock is used to ensure inaccessibility to the pool. LPAs observed that AB2866 requirements are not being met at this time. LPAs reviewed the requirements with the Licensee and provided a copy of the requirements. Licensee was advised that all poisons must be locked, not only inaccessible to children. Per facility representative there are no pets in the home. Per Licensee there is no overnight care provided. Page 3 Infant Care : Per Licensee, currently there are no infants enrolled. LPA reviewed the safe sleep regulation with Licensee. Children\342\200\231s records were reviewed and included (LIC) 282- Affidavit Regarding Liability Insurance, Immunization Records, LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment, LIC 995A Notification of Parents\342\200\231 Rights. Staff records were reviewed and contained required documents. Licensee Lee Colbert's red cross pediatric first aid expires 3/17/2027. Licensee Hyacinth Colbert's first aid cpr certification does not state pediatric (states BLS) and expires 12/2025. Both Licensees mandated reporter training certificates are expired. LPAs advised that both mandated reporter training and pediatric first aid/cpr must be updated every two years. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Page 4 Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, the Licensee Lee Colbert, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. Three type B deficiencies are being issued today. Please see 809-D A notice of site visit was given and must remain posted for 30 days.
