Based on LPA's observation, the licensee did not comply with the section cited above in that LPA observed two electrical outlets without the plate covered. LPA observed two holes in the wall. This is unsafe and poses a potential health, safety or personal rights risk to persons in care.

102423(a)(4) -Personal Rights -Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (4)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, This is evidences by: Based on interviews and demonstration, Licensee uses inappropriate discipline with the day care children. LPA uses improper time-out by placing the children in the corner. Also, according to children, the licensee yells at the children as a form of discipline. This is an immediate risk to the health and safety to children in care.

LPA observed a notebook whereby the lciensee keeps notes and has noted some infant napping times. This poses a potential health, safety or personal rights risk to persons in care.

102416.5 (e) -Staffing Ratio and CapacityIf no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). Licensee failed to comply with Title 22 Regulation in regards to having an assistant on the premises. The evidence was met by LPA observed 9 children present alone with licensee. The license converts back to a small license without an assistant. This causes the licensee to be out of ratio. This is an immediate risk to the health and safety of children in care.

This is required according to Title 22 Regulatiosn and is a potential risk to the children in care.
