What the inspector wrote

On 4/28/23 at 1:45PM, Licensing Program Analyst (LPA) V. Wheatley conducted an inspection regarding the above allegation. Upon arrival LPA was greeted by licensee Jacquelyn Jamison who was supervising 9 children inside of the home. Licensee stated that her assistant Staff #1 left to take a break. The assistant returned at 2:30PM. Licensee left at 2:45PM to pick up 5 school aged children. LPA conducted an inspection on February 9, 2023 and observed 10 children with the licensee and Staff #1. Based on LPA's observance today the above allegation is substantiated. Thel licensee was alone with 9 children inside the home in the day care room. Although licensee states her adult grandson was on the premises in the attached garage. None of the children were school aged. The substantiated allegation is valid because the preponderance of the evidence standard has been met. Licensee is cited Type A deficiency, according to California Code of Regulations Title 22 Regulation (102416.5e). Once there is not an assistant the license converts to a small license which cause the licensee to be out of rato. See 9099D report for deficiencies. Exit interview. A copy of this report was provided to licensee. A copy of this report must be given to all the parents of any child enrolled and any child that is enrolled within the next 12 months. Licensee is to post Notice of Site Visit for 30 Days.

    OPERATION OF A FAMILY CHILD CARE HOME

    102417(a) Operation of a Family Child Care Home-The licensee shall be present in the home and shall ensure that children in care are supervised at all times. Licensee failed to visually supervise day care children properly. The evidence was met as a minor child touched another minor child inappropriately. This is an immediate risk to the health and safety to children in care.

  • PERSONAL RIGHTS

    102423(a)(2) -Personal Rights -Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (2) To receive safe, healthful, and comfortable accommodations. Licensee failed to protect a day care child from being touched inappropriately by another child in care. This is an immediate risk to the health and safety to children in care.

  • REPORTING REQUIREMENTS

    102416.2(b)-Reporting Requirements-The licensee shall report to the Department any of the events as specified in Health and Safety Code Sections 1597.467(b)(1)(A) through (b)(1)(C) that occur during the operation of the family child care home. Licensee failed to report an unsual incident to the Department that occurred between two day care children. This is required according to Title 22 Regulatiosn and is a potential risk to the children in care.

  • PERSONAL RIGHTS

    102423(a)(4) Personal Rights- Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following:To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature.... LPA interviewed children who stated that the licensee places them in the corner on time out. LPA interviewed the licensee who admitted that she places the children in time out standing in the day care room and that she did not know this was a violation.

  • STAFFING RATIO AND CAPACITY

    102416.5 (e) -Staffing Ratio and CapacityIf no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). Licensee failed to comply with Title 22 Regulation in regards to having an assistant on the premises. The evidence was met by LPA observed 9 children present alone with licensee. The license converts back to a small license without an assistant. This causes the licensee to be out of ratio. This is an immediate risk to the health and safety of children in care.
