What the inspector wrote

Based on record review and interview, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. A type A deficiency is being cited today in accordance with California Code of Regulations Title 22: regulation 101416.5(b) Staff – Infant Ratio. This is a repeat violation originally cited on 4/21/23 and a civil penalty of $250 is assessed today. The notice of site visit was posted where the parent/guardian of children enter and exit the facility. A copy of this report shall also be posted where the parent/guardian of children enter and exit the facility. Both the notice of site visit and licensing report shall remain posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon their return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled child for the next 12 months. A signed Acknowledgement of Receipt (LIC9224) shall be in each child’s file, acknowledging receipt. This report along with a copy of the appeal rights was provided.     Staff-Infant Ratio:(b) There shall be a ratio of one teacher for every four infants in attendance. This requirement was not met as evidenced by: based on record review and staff disclosure, the facility operated out of ratio on at least two dates in the month of June 2023. Director confirmed that the facility has operated out of ratio.This is an immediate risk to children in care.
