What the inspector wrote

On 12/09/2021 at 08:23 a.m., Antonio Almanza, Licensing Program Analysts, conducted an unannounced visit for the purpose of completing Comprehensive Case Management Report. During todays visit LPA met with Susan Glamuzina, Director, and toured that facility. During today’s visit there are 1 adults providing care and supervision to 6 children in care. On 12/07/2021 at 12:17 a.m., Antonio Almanza and Lourdes Castellanos, Licensing Program Analysts, conducted an unannounced Comprehensive Case Management visit. LPA’s met with Susan Glamuzina, Director, and toured that facility indoors and outdoors. There were 3 adults providing care and supervision to 11 children. Days and hours of operation are 7 days per week 24-hours per day. LPAs verified the facility phone number is (818) 892-6644. Per Stipulation and Waiver; and Order the facility is on Probation for 3 years effective August 29, 2019. There is an in-ground swimming pool that is fenced with wrought iron gate. At 1:14 pm LPA observed the gate is not self-latching and has a padlock on the latch. There are three different locations on the fence surrounding the swimming were the welding’s have eroded due to corrosion and have come loose and as a result the fence is not secure. Please see facility # 197407320 for citation. Furniture and equipment are in good condition, free of sharp, loose or pointed parts. Playground equipment is in safe condition, free of sharp, loose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. Toilets and hand washing facilities are in safe and sanitary operating condition. Solid waste storage container in the kitchen has a broken lid. LPAs observed the kitchen child safety gate tied to a string keeping it open. LPAs observed two broken kitchen drawers next to the gate, one of the drawers had knifes and sharp items inside. LPAs observed a drawer next to the kitchen sink without a safety latch and knifes inside. Pg 1. LPAs observed the kitchen cabinet underneath the sink to be broken and in disrepair. The classroom next to the kitchen did not have children present. LPAs observed cleaning supplies and poisons underneath the kitchen sink that were not being made inaccessible by lock or safety latch. There is a hamster next to the kitchen besides food storage area and food preparation area. Drinking water is available both indoors and outdoors. Areas around high climbing equipment, swings and slides have cushioning material to absorb falls. The facility is free of flies, insects and rodents. Facility has one or more functioning carbon monoxide detectors that meet statutory requirements. The door that leads to the Directors office does not have a lock or child safety nob that can make it inaccessible to children. LPAs observed cleaning and disinfecting supplies in this area. Prior to working or volunteering in a licensed child care facility, all individuals subject to a criminal record review have received a criminal record clearance or exemption. There is at least one person trained in CPR and Pediatric First Aid is present when children are at the facility or at off site activities. The name of the child care center director or fully qualified teacher(s) designated to act in the director’s absence has been reported to the Department. During the visit on 12/08/21 LPAs observed that 1 of 14 children signed in and 2 children gone but one did not sign out, Director stated the child was taken to school from the center and the staff did not sign him out. LPA Castellanos reviewed a sample of children’s files and observed files ( were / were not ) complete with: Identification and Emergency Information (LIC700, Child’s Preadmission Health Evaluation (LIC702), Physician Report (LIC 70, if not enrolled in elementary school), Consent for medical Treatment (LIC627), Immunization Records (“Blue Cards”, PM286 for non -school-age children), Current Admissions Agreement with signature, Notification of Parents’ Rights (LIC995), Personal Rights (LIC613A). Per Stipulation and Waiver; And Order children’s files have signed acknowledgement of being provided a copy of Stipulation but do not have signed acknowledgement of being provided a copy Accusation. There are no children with a Restricted Health Condition. LPA Castellanos reviewed a sample of staff files and observed files were complete with health screening, immunization records for, influenza (current), pertussis and measles and current documentation of completed Mandated Reporter Training, Health Screening Report (TB), Personnel Record (LIC501), Teacher Qualification (LIC9095), Director Qualifications (LIC9096), Transcripts, Criminal Record Statement (LIC508), Notice of Employee Rights (LIC9052), Statement Acknowledging Requirement to Report Suspected Child Abuse (LIC9108). Pg 2. Director reports that staff have received training. Per Stipulation, LPA is unable to verify that Staff are provided 24 hours of quarterly training on applicable Tittle 22 Regulations, including Mental Health Assessment, Client Behaviors, Personal Rights, Care and Supervision, and Medication; records of staff receiving training are not available for review. On 12/07/21 there was not a clear written statement of the administrative responsibility and authority delegated to the child care center director and a copy of this written statement was given to the child care center director and has not been made available to the Department upon request. At this time LPA is unable to determine if facility staff are working more than eight (8) hours per day, due to facility not providing work schedule or staff time cards Per Director the owner Peggy Nairn only has access to this information (LAP is requesting this information by 12/09/21). LPAs did not observe the following items posted in a location were parent in the Infant Center can see them: Personal Rights Form LIC-613A, Child Care Center Notification of Parents' Rights Poster PUB 393, and Notice of Site Visit for 12/08/21. The Stipulation is posted in a conspicuous place at the facility for parents to view. Capacity and limitations of the Licensed facility are not being maintained. The facility is currently operating an exempt school age program that was taken away by the department in an in-office None Compliance Conference meeting held on 07/08/2011. Per Stipulation Waiver; and Order the Waiver to allow care for 12 school age children was revoked. Director was provided an updated facility License that no longer shows 12 children ages 5 years through 12 years. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiencies are being cited: three (3) Type As and ten (10) Type Bs (please see LIC 809-D for cited deficiencies). Director was provided a copy of their appeal rights. Upon receipt of a Type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of LIC 9224 was given to Susan Glamuzina. A copy of this report was explained and provided to Director Susan Glamuzina and Administrator Tammy Jacquin. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days. Pg 3.
