1596.857, (a) Upon presentation of identification... parent or guardian... has the right to enter and inspect the facility without advance notice during the normal operating hours of the facility or at any time that the child is receiving services in the facility...This Requirement is not met as evidenced by: Based on observation, interview and record review, 3 of 4 staff interviewed are reporting that parents are not allowed to enter the facility, which poses a potential Health or Safety, or personal rights risk to persons in care.

HEALTH AND SAFETY CODE SECTION

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

101229(a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation.This Requirement is not met as evidenced by: Based on interview and record review, Staff 3 did not observe children in bathroom splashing water resulting in S3 reacting inapropriately, which poses an immediate Health and Safety, and personal rights risk to persons in care.

REPORTING REQUIREMENTS

TEACHER-CHILD RATIO

There is no Actual Director on site during these times. The evening, night and weekend Directors are assigned to classroom as teachers when they are supposed to be the Director.

Child Care Center Directors Qualifications and Duties,High school graduation or GED; completion, with passing grades, of 15 semester or equivalent quarter units as specified in (h)(1)(A) and (h)(1)(B) below at an accredited or approved college or university; and at least four years of teaching experience in a licensed child care center or comparable group child care program.This requirement is not met as evidenced by:Director does not meet the qualifications for director based on transcripts which poses a potential health, safety or personal rights risk to persons in care.

Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children.This requirement is not met as evidenced by: LPAs observed cleaning supplies and poisons underneath free-stand sink in the classroom, which poses a potential Health or Safety, or personal rights risk to persons in care.

INFANT CARE CENTER DIRECTOR QUALIFICATIONS AND DUTIES

FIXTURES, FURNITURE, EQUIPMENT AND SUPPLIES
