On 4/07/22 at 08:20 a.m., Antonio Almanza, Licensing Program Analysts, conducted an unannounced visit for the purpose of clearing Plan of Corrections (POCs) for citations issues on 03/25/2022. LPA met with the Director MagalyZuniga, explained the purpose of the visit, and toured that facility. During today’s visit there were 2 adults providing care and supervision to 13 children in care. Corrections for 7 violations have been cleared and POC letters were provided. The facility has not corrected the following 6 violations by the POC due date: 1. 101215.1(d) Child Care Center Directors Qualifications and Duties, The child care center director, or the substitute director as specified in (f) below, shall be on the premises during the hours the center is in operation. Based on observation and records review, The Licensee does not have a Director assigned to the Facility During all hours of operation, which poses a potential Health or Safety, or personal rights risk to persons in care. 2. 101215.1(c) Child Care Center Directors Qualifications and Duties, The child care center director shall be responsible for the operation of the center, for compliance with regulations, and for communications with the Department... The Licensee does not have an actual Director During the Evening and Night programs. The Assigned Directors during these times, are classroom teachers, and are assigned to classrooms. 3. Per Stipulation; Waiver and Order, Licensee shall provide 24 hours of quarterly training to staff on mental health assessments, client behaviors, personal rights, care and supervision, and medication and keep a record of staff who attend such training and make records available to Licensing. The records that have been submitted to the RO do not meet the training requirements of the Stipulation. Pg 1 of 8 4. 101238 Buildings and Grounds, The area around the walkway in front of storage building has stacked miscellaneous items. Items were not completely removed from next to the walk way in front of the storage building and placed in general or portable storage, or removed from the facility, by 04/01/22. 5. Per Stipulation no employee shall work more than eight (8) hours per day. Director/Licensee did not provide a Mitigation Plan demonstrating how the facility will ensure to be fully staffed at all times and that no employee shall work more than eight (8) hours per day. Staff are reporting that they worked over time after the violations was issued on 03/28/22. 6. 101170(e)(2) Criminal Record Clearance, (e) All individuals subject to a criminal record review... (2) Request a transfer of a criminal record clearance as specified in Section 101170... Director will have the Licensee associate Staff 2 to the facility and staff 2 will not be allowed back until associated to the facility. According to information provided Staff 2 has continued to be in the facility since 03/28/22. During today’s visit 6 Civil penalties for failure to correct POCs were issued. Please see LIC421FC During today’s visit the following violations are being cited under Title 22 Regulations, Division 12, Chapter 1, of the California Code of Regulations, and Health & Safety Code (please see LIC 809-Ds for cited deficiencies). 1. At 10:11 a.m., LPA observed a bag of Tide pods in a bottom shelf of a cabinet in the classroom that is accessible to children in care. 2. At 9:54 a.m., LPA observed the trash can in the classroom that is used for all waste has a broken lid, LPA observed a trash can in front of the facility entrance that is also used for all waste and is open on the sides. Director was advised that all solid waste trash cans in the facility must always have a tight-fitting lid. Pg 2 of 8 3. At 10:33 p.m., LPA requested Plan of Operations, Parent Handbook and the Directors File. Parent Hand Book and Director file were provided. The Owner Peggy Nairn informed Staff 1 that if LPA Needed a copy of the Parent Handbook she could email it another day. 4. The Director states she has not been provided a clear written statement of the administrative responsibility and authority delegated to the child care center director. Director Has been Advised that All Director Documents need to be submitted to the Regional Office for review by 4/13/22. LPA discussed and provided the Director with document outlining all required documents to be provided. Upon receipt of a Type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of LIC 9224 was provided to Director Magaly Zuniga. A copy of this Report (809 & 809Ds) and appeal rights were explained and provided to the Director Magaly Zuniga. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit was provided and required to be posted for 30 days. Pg 3 of 8
