SIGN IN AND SIGN OUT

Based on observation and record review, the licensee did not comply with the section cited above in that Child 6 was not signed in during drop off and Child 7 was signed out but still in the facility, which poses/posed a potential health, safety or personal rights risk to persons in care.

PERSONNEL REQUIREMENTS

Based on observation and record review, the licensee did not comply with the section cited above in Staff 4 does not have a complete Helath Screaning Report LIC503 on file, which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on interview, the licensee did not comply with the section cited above in that the Adminsitrator and Director have reported that staff have been working more than 8 hours which is in Violation of Stipulation, which poses/posed a potential health, safety or personal rights risk to persons in care.

REPORTING REQUIREMENTS

101212(d) Reporting Requirements, Upon the occurrence... a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours...This Requirement is not met as evidenced by: Based on observation, interview and record review, The facility did not report the Incident to CCLD, which poses a potential Health or Safety, or personal rights risk to persons in care.

BUILDINGS AND GROUNDS

101238(a) Buildings and Grounds - The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.This Requirement is not met as evidenced by: Based on observation, LPA observed 5 bins with miscellaneous items full of cobwebs, 3 large metal grid boxes, 3 ladders standing up right and a drain hole that does not have a cover, which poses a potential Health or Safety, or personal rights risk to persons in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

01229(a)(1) Responsibility for Providing Care and Supervision - No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.This Requirement is not met as evidenced by: Based on observation, LPA observed 5 children unsupervised while the teacher conducted wellness check of a child at he door, which poses a potential Health or Safety, or personal rights risk to persons in care.

101215.1(c)(1) Child Care Center Directors Qualifications and Duties - There shall be a clear written statement of the administrative responsibility and authority delegated to the child care center director. LPA and Director did observe a signed document by Director Magaly Zuniga for Teacher/Teacher Assistant qualifications and Duties.This requirement is not met as evidenced by: Based on record reviews and interviews, there is no clear written statement of the administrative responsibity and authority delegated to the child care center director,which poses a potential health, safety or personal rights risk to persons in care.

Per Stipulation Licensee shall provide 24 hours of quarterly training and keep a record of staff who attend such training and make records available to Licensing.This requirement is not met as evidenced by: Based on records review, The Licensee does not have records available for the 24 hours of quarterly training on required training, which poses a potential Health or Safety, or personal rights risk to persons in care.

101238 Buildings and Grounds (g) Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children. (1) Storage areas for poisons shall be locked.This Requirement is not met as evidenced by: Based on LPA observations and records review, LPA observed an open bag of Tide Pods in a bottom shelf tha is accessible to children, which poses an immediate Health and Safety, and personal rights risk to persons in care.

101238 Buildings and Grounds (d) General permanent or portable storage space shall be available for the storage of the center's equipment and supplies. Based on observation LPA observed the area next to the walkway next to storage building with stacked miscellaneous items, which poses a potential Health or Safety, or personal rights risk to persons in care.

FIXTURES, FURNITURE, EQUIPMENT AND SUPPLIES

101239 (f )(1) Fixtures, Furniture, Equipment and Supplies, All containers used for storage of solid wastes, including moveable bins, shall have a tightfitting cover that is kept on; shall be in good repair; and shall be leakproof and rodent-proof.This Requirement is not met as evidenced by: Based on observation, The Licensee did not make sure to have a lid on trash can in classroom and in facility entrance, which poses a potential Health or Safety, or personal rights risk to persons in care.

CRIMINAL RECORD CLEARANCE

101170(e)(2) Criminal Record Clearance, (e) All individuals subject to a criminal record review... (2) Request a transfer of a criminal record clearance... Section 101170...This requirement is not met as evidenced by: Based on LPA observations and records review, Staff 2 was not associated to the facility from 03/28/22 until 04/07/22, which poses an immediate Health and Safety, and personal rights risk to persons in care.

101200 (c)(1) Inspection Authority of the Department, (c) The Department has the authority to inspect... child care center records upon demand ... (1) The licensee shall ensure that provisions are made for the examination of all records relating to the operation of the child care center. Based on interviews, The Licensee and Director did not provide LPA with Plan of Operation, which poses a potential Health or Safety, or personal rights risk to persons in care.

101216(l) Personnel Requirements (l) All personnel shall be informed of their rights pursuant to Sections 1596.881 and 1596.882 of the Health and Safety Code. Based on interviews and records review staff have continued to work more than 8 hours, which poses a potential Health or Safety, or personal rights risk to persons in care.

101223 Personal Rights (b)(2) The center shall post a copy of the LIC 613A (9/96) in a prominent, publicly accessible area in the center. Based on Observation a copy of the LIC 613A is not posted in a prominent, publicly accessible area of the center, which poses a potential health, safety or personal rights risk to persons in care.

101224(a) Telephones, All child care centers shall have working telephone service on the premises.This requirement is not met as evidenced by: Based on LPAs observations and information provided the facility does not have a working phone, which poses an immediate Health and Safety, and personal rights risk to persons in care.

FOOD SERVICE

Food Services 101227(a)(19)All food shall be protected from contamination. Contaminated food shall be discarded immediately.This requirement is not met as evidenced by: Based on LPA observations there was expired food in the refrigerator, which poses an immediate Health and Safety, and personal rights risk to persons in care.

OUTDOOR ACTIVITY SPACE

101238.2 Outdoor Activity Space (d) The surface of the outdoor activity space shall be maintained: (2) Free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard.This Requirement is not met as evidenced by: Based on observation LPAs observed two trees with a circular barrier lower than the turf around, which poses a potential Health or Safety, or personal rights risk to persons in care.

101215.1(h)(1) Child Care Center Directors Qualifications and Duties, High school graduation or GED; completion, with passing grades, of 15 semester or equivalent quarter units as specified in (h)(1)(A) and (h)(1)(B) below at an accredited or approved college or university...This requirement is not met as evidenced by: Based on records review, Staff 1 does not have the qualifications to be Director, which poses a potential Health or Safety, or personal rights risk to persons in care.

(h) Child care center directors shall have completed one of the following prior to employment:(1) High school graduation or GED; completion, with passing grades, of 15 semester or equivalent quarter units as specified in (h)(1)(A) and (h)(1)(B) below at an accredited or approved college or university; and at least four years of teaching experience in a licensed child care center or comparable group child care program.This requirement is not met as evidenced by:Based on record review LPAs did not find the Director met the qualifications for director based on transcripts which poses a potential health, safety or personal rights risk to persons in care.

All personnel shall be given on-the-job training in the areas listed below, or shall have related experience that demonstrates knowledge of and skill in those areas. As a condition of the Stipulation Licensee shall within 60 days of the adoption of this Stipulation, provide 24 hours of training to staff on mental health assessments, client behaviors, personal rights, care and supervision, and medication and keep a record of staff who attend such trainings and make records available to LicensingThis requirement is not met as evidenced by:Based on record reviews no records were available to review which poses a potential health, safety or personal rights risk to persons in care.

BUILDINGS AND GROUNDS

Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children.This requirement is not met as evidenced by:. Based on observations Rinse Free Floor Cleaner was accessible to the children in the preschool classroom behind the laundry basket near the safety gate entrance to the storage/laundry room when the children were asleep which poses a potential health, safety or personal rights risk to persons in care.

As a condition of the Stipulation and Waiverand Order dated 08/19/2019 licensee is required nto provide all parents with a copy of Stipuation and Waiver and Order with Accusation attached iforming them of the Probetionaty status of the license.This requirement is not met as evidenced by: LPAs reviewed 6 files. Based on file review LPAs observed acknowledgement forms (LIC9224) were for Stipulation only and not for the Accusation which poses a potential health, safety or personal rights risk to persons in care.
