What the inspector wrote

On March 27, 2023 at 11:15am, Licensing Program Analyst (LPA) Dayna Chambers conducted an unannounced complaint inspection for the purpose of delivering findings for the above allegation. Upon arrival, LPA met with Katrina Williams, Site Supervisor/Teacher and toured the facility. Upon arrival, there were 24 staff and 6 children in care. During the investigation, LPA Chambers conducted interviews with Staff and reviewed relevant department database “FAS”, regarding the above allegation. LPA reviewed the FAS database on 02/28/23 attempting to locate an unusual incident report for the incident occurring on February 10, 2023. LPA could not locate any unusual incident reported by the center via phone call or required written LIC624 as required by Title 22 Reporting Requirements reporting a child injury that requires medical treatment. In addition, LPA spoke to staff who stated they were not aware they needed to report the incident that occurred on February 10, 2023 because they were not aware of the incident until after the date of occurrence. Based on statements made by staff, interviews with staff, and record review in the department database-FAS, there is a preponderance of the evidence to prove that the facility failed to report the incident that occurred on 02/20/23, a child injury requiring medical treatment. Therefore, the allegation is substantiated. Deficiency was cited during today's inspection. Appeal rights were provided and discussed with the facility representative. A Notice of Site Visit (LIC 9213) was given and must remain posted for 30 days. Exit interview was conducted and report was reviewed with Site Supervisor/Teacher, Katrina Williams

    Citation: 101212(d)(1)(B)- reporting requirements: Title 22, Division 12, Chapter 1, Article 06. Continuing Requirements (d) Upon the occurrence, during the operation of the childcare center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1) Events reported shall include the following: (B) Any injury to any child that requires medical treatment. This requirement is not met as evidenced by Based on statements made by staff, interviews with staff, and record review in the department database-FAS, there is a preponderance of the evidence to prove that the facility failed to report the incident that occurred on 02/20/23, a child injury requiring medical treatment. which poses/posed a potential Health, Safety, or Personal Rights Risk to children in care.

    Day Care Child Sustained Unexplained Fracture- 101229(a)(1)Title 22, Division 12, Chapter 1, Article 06. Continuing Requirements 101229(a)(1)Responsibility for Providing Care and Supervision (a)The licensee shall provide care and supervision as necessary to meet the children's needs.(1)No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met based on Based on interviews, observation of surveillance video dated 02/10/22, and record reviews, Owie Report dated 02/10/22, medical records, a child sustained an injury at the facility that was not visually observed by any staff which posed a potential health and safety risk to persons in care.
