Based on record review, the licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.

REPORTING REQUIREMENTS

Citation: 101212(d)(1)(B)- reporting requirements: Title 22, Division 12, Chapter 1, Article 06. Continuing Requirements (d) Upon the occurrence, during the operation of the childcare center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1) Events reported shall include the following: (B) Any injury to any child that requires medical treatment. This requirement is not met as evidenced by Based on statements made by staff, interviews with staff, and record review in the department database-FAS, there is a preponderance of the evidence to prove that the facility failed to report the incident that occurred on 02/20/23, a child injury requiring medical treatment. which poses/posed a potential Health, Safety, or Personal Rights Risk to children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

Day Care Child Sustained Unexplained Fracture- 101229(a)(1)Title 22, Division 12, Chapter 1, Article 06. Continuing Requirements 101229(a)(1)Responsibility for Providing Care and Supervision (a)The licensee shall provide care and supervision as necessary to meet the children's needs.(1)No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met based on Based on interviews, observation of surveillance video dated 02/10/22, and record reviews, Owie Report dated 02/10/22, medical records, a child sustained an injury at the facility that was not visually observed by any staff which posed a potential health and safety risk to persons in care.

Personal Rights:(a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. This requirement was not met as evidenced by interviews conducted with Staff, parent written statement .Staff (1) exchange the children clothes during picture day at school day. This poses an risk to safety and personal rights risk to the children in care.

ARTICLE 1. General Provisions and Definitions

Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement is not met as evidenced by: Based on observation Staff #3 was missing proof of required immunizations, which poses a potential Health, Safety or Personal Rights risk to children in care.

(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.This requirement is not met as evidenced by: Based on record review, the director did not comply with the section cited above where three staff members did not have an up to date Mandated Reporter Training completed on file, which poses a potential health, safety or personal rights risk to persons in care.
