101239 Fixtures, Furniture, Equipment and Supplies(m) All play equipment and materials used by children shall be age-appropriate.This requirement is not met as evidenced by: Based on interviews with staff and LPA’s observation, facility is allowing their Toddler Component classroom to use children’s apparatus that is designed for children ages 2 years old to 5 years old. Toddler Classroom enrollls chidlren ages 18-30 months.

101216.4(a) Licensees serving preschool-age children may create a special program component for children who are between 18 months and 36 months of age... participating in a preschool toddler component, in addition to those specified in Health and Safety Code section 1596.955. (1) A child who is between 18 months and 36 months of age may participate in the toddler program with written permission from the child's authorized representative. No child in the toddler program shall be placed in the preschool program before the age of 30 months without written permission from the child's authorized representative. This requierment is not met by evidence by LPA's observation and record review facility does not obtain a clear written permission for a child to participate in the toddler program whichpose which poses a potential health, safety or personal rights risk to persons in care.

PRESCHOOL PROGRAM WITH TODDLER COMPONENT

101216.4(a) Licensees serving preschool-age children may create a special program component for children who are between 18 months and 36 months of age... shall apply for children over 24 months, in addition to those specified in Health and Safety Code section 1596.955. The provisions of Sections 101351 through 101439.1 shall apply for children between the ages of 18 and 24 months participating in a preschool toddler component, in addition to those specified in Health and Safety Code section 1596.955.(2) The toddler program shall be conducted in areas physically separate from those used by older or younger children. Space planning and usage for the toddler component shall be governed by the provisions of Section 101438.3. Plans to alternate use of outdoor play space must be approved by the Department. This requierment is not met as evidence by director's interview confirming toddlers and preschool children have a shared outdoor time and area.

ALTERATIONS TO EXISTING BUILDINGS OR NEW FACILITIES

101237 Alterations to Existing Buildings or New Facilities(a) Prior to construction or alterations, the licensee shall notify the Department of the proposed change(s). This requirement is not met as evidenced by facility's current classroom structure- demolition of wall between classroom 2 and 3, creating one classroom.
