What the inspector wrote

On 02/15/2023 LPA Clayton conducted investigative interviews with C2, C3, C4 and C5. Based on LPA observation and interviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California code of Regulations Title 22, Division 12 Chapter 1 Personal Rights 101223(a)(1)(3) is being cited on the Facility Evaluation Report LIC 9099D. An exit interview was conducted with Director Priscilla Rivera, and a copy of this report and Appeal rights were provided. The Notice of Site Visit (LIC 9213) \342\200\223 must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.

    101223(a)(3)(a) The licensee shall ensure that each child is accorded the following personal rights: (1)To be accorded dignity in his/her personal relationships with staff and other persons. (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement is not met as evidenced by: Based on LPA interview with the child mentioned in the complaint the teacher in fact handled her inappropriately. Interviews with other children in care revealed that when they don’t listen, the teacher in question gets upset, rude and yells at them, which poses an immediate Health, Safety, or Personal Rights risk to the children in care.
