What the inspector wrote

On 11/06/2025 LPA Clayton conducted an unannounced Case Management inspection at the CCC. LPA was greeted by Director Rafeda Shamsa. LPA Clayton toured the CCC inside and outside for Health & Safety inspection, and observed 12 children, being supervised, and cared for by 4 fingerprint cleared staff. On September 08,2025, LPA Clayton arrived at the CCC unannounced and observed teacher S1 supervising 6 children. LPA Clayton reviewed the facility Guardian roster and noted that S1 was not associated to the facility. Further investigation revealed that S1 did not have a fingerprint clearance in Guardian. Director Rafeda arrived shortly after and informed LPA Clayton that S1 stated she had a clearance because she worked at a school in the area. LPA Clayton called the Regional Office and verified that there are no fingerprints on file for S1. LPA Clayton instructed Director to gain access to Guardian to look for clearances or simply call the regional office and provide identifying information to verify a fingerprint clearance is granted prior to anyone over the age of 18 either working, residing or volunteering at the Child Care Center. LPA Clayton\342\200\231s file review of staff time sheets showed S1 working at the CCC beginning September 2, 2025. LPA Clayton verified that S1 was fingerprinted on September 9, 2025, and a clearance was granted on September 10, 2025. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, a Type A deficiency was cited and Civil Penalties assessed (see LIC 809D). Director is to provide parents of currently enrolled children and parents of children enrolled over the next 12 months copies of the Licensing Report containing the Type A violation and maintain a signed copy of the LIC 9224 in the children\342\200\231s files. An exit interview was conducted, and this report and Appeal Rights were discussed and provided to Director Rafeda. LPA Clayton posted a notice of site visit which must remain posted for 30 days.

    (d)An aide assisting a fully qualified teacher (as specified in Section 101216.1(c)) in the supervision of up to 18 preschool-age children, pursuant to Section 101216.3 shall meet the following requirements: (1) Completion of six postsecondary semester or equivalent ………….or (2) Completion of at least two postsecondary semester units or equivalent………or child development each semester or quarter following initial employment, and (3) Continuation in the educational program each semester or quarter until six units have been completed. (e)n aide shall work only under the direct supervision of a teacher. This requirement was not met as evidenced by: LPA Clayton record review of the staff file and the inability to veriry the education requirement was met, and LPA Clayton observed the staff supervising children in the absence of a fully qualified teacher.

    Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. (3) To be free from corporal or unusual punishment, ..........or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by: LPA Clayton's observation of staff repeatedly send a child outside without assessing the child’s needs, (eating, toileting, etc.) which is a violation of the child’s personal rights.

    101170 Criminal Record Clearance (e) All individuals subject to a criminal record review...shall prior to working, residing or volunteering in a licensed facility:(1) Obtain a California clearance or a criminal record exemption asrequired by the Department or....... This requirement is not met as evidenced by:LPA Clayton observed teacher S1 working at the CCC, and LPA records review, staff S1 begin work at the facility on September 2, 2025. Fingerprints were submitted on 09/09/2025.
