    101212 (d)(1)(B)-Reporting Requirements- Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. This requirement was not met as evidenced by: LPA Wheatley was informed by the director and other witness that Child #1 was injured with scissors while at the day care. The child was taken to the doctor. The injury was not reported to Licensing. This poses a potential risk to the immediate Health and Safety risk to the health and safety child in care.

(B) A child shall not be served any food to which the child's record indicates he/she has an allergy. This requirement was not met as evidenced by: Director's acknowledgement that on at least one occsasion, the child in care was served food indicated in her file as an allergen, which posed an immediate Health and Safety risk to children in care.

This requirement was not met as evidenced by: LPA Clayton's observation of the staff forcing the children to sleep and forcing the children to wake up from their nap which poses a Health and Safety Risk to children in care.

This requirement was not met as evidenced by: LPA Clayton's observation that the children in the Dolphin class are not having their toileting/diapering needs addressed until a another teacher arrives at 10am, which posed a Health and Safety risk to children in care.

This requirement was not met as evidenced by: LPA Clayton interviews revealed that the student bit a teacher, which required medical attention and the incident was not reported to the parent or the department in the time frame outlined in the above mentioned regulation, which posed an immediate Health and Safety risk to the child in care.

This requirement is not met as evidenced by:LPA Clayton observed teacher S1 working at the CCC, and LPA records review, staff S1 begin work at the facility on September 2, 2025. Fingerprints were submitted on 09/09/2025.

This requirement was not met as evidenced by: LPA Clayton's observation of staff repeatedly send a child outside without assessing the child’s needs, (eating, toileting, etc.) which is a violation of the child’s personal rights.

This requirement was not met as evidenced by: LPA Clayton record review of the staff file and the inability to veriry the education requirement was met, and LPA Clayton observed the staff supervising children in the absence of a fully qualified teacher.
