What the inspector wrote

LPA Clayton conducted a thorough investigation which included facility inspections, observations, and staff interviews referencing the above-mentioned allegations. LPA Clayton heard and visually observed teachers telling children who were sitting up to \342\200\234lay down, right now\342\200\235 and telling children who were laying down to \342\200\234close their eyes and go to sleep\342\200\235. LPA Clayton observed teachers patting children on the back for more than 20 minutes, to get them to go to sleep. LPA also heard staff tell children \342\200\234it\342\200\231s time to wake up\342\200\235 all of which are a violation of the children\342\200\231s Personal Rights. LPA Clayton reviewed the CCC \342\200\234daily diaper log\342\200\235 and observed dates where the children were in attendance, but there were no entries. LPA Clayton also observed that during multiple visits, the children\342\200\231s diaper/toileting needs not being met until another teacher arrived at 10am. Based on information obtained during the investigation that included LPA Claytons observation, it has been determined that staff force children to nap, staff force children to wake up from their nap, and staff did not meet the child's diapering care needs, all of which are a violation the children\342\200\231s Personal Rights. The preponderance of evidence standard has been met; therefore, the allegations are found to be SUBSTANTIATED. Type B Violations of the California Code of Regulations, Title 22101223 (a) (1) (3) is cited on the attached LIC 9099-D. An exit interview was conducted, and this report was reviewed with Director Rafeda, and Appeal Rights were discussed and provided. LPA Clayton posted a notice of site visit which must remain posted for 30 days.     101223 (a) (1) (3) Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, …….or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting……. This requirement was not met as evidenced by: LPA Clayton's observation of the staff forcing the children to sleep and forcing the children to wake up from their nap which poses a Health and Safety Risk to children in care.

    101230 Activities (a) Each center shall provide a variety of daily activities designed to meet the needs of children in care, including but not limited to: (4) Toileting. This requirement was not met as evidenced by: LPA Clayton's observation that the children in the Dolphin class are not having their toileting/diapering needs addressed until a another teacher arrives at 10am, which posed a Health and Safety risk to children in care.

(3) To be free from corporal or unusual punishment, infliction of pain, …….or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping……. This requirement was not met as evidenced by: The child in care suffered a dislocated elbow in care, and LPA Clayton's observation of teacher S1 pulling children by the wrist, and arm, which poses and immediate Health and Safety risk to children in care.

    (7) Modified diets prescribed by a child's physician as a medical necessity shall be provided. (B) A child shall not be served any food to which the child's record indicates he/she has an allergy. This requirement was not met as evidenced by: Director's acknowledgement that on at least one occsasion, the child in care was served food indicated in her file as an allergen, which posed an immediate Health and Safety risk to children in care.
