What the inspector wrote

Based on information obtained during the investigation that included LPA observations, the allegation of Reporting Requirement is found to be UNSUBSTANTIATED, meaning that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur. Exit interview conducted and report was reviewed with Director Rafeda Shamsa. LPA Clayton posted a Notice of Site visit which is to remain posted for 30 days. Based on information obtained during the investigation that included LPA Claytons observation, it has been determined that the child sustained an injury while in care, which is a violation of her Personal Rights, and the staff did not meet her dietary needs by serving her food they were made aware that she is allergic to. The preponderance of evidence standard has been met; therefore, the allegations are found to be SUBSTANTIATED. Type a Violations of the California Code of Regulations, Title 22, 101223 (a) (1) (3) is cited on the attached LIC 9099-D. Director is to provide parents of currently enrolled children and parents of children enrolled over the next 12 months copies of the Licensing Report containing the Type A violation and maintain a signed copy of the LIC 9224 in the children\342\200\231s files. An exit interview was conducted, and this report was reviewed with Director Rafeda, and Appeal Rights were discussed and provided. LPA Clayton posted a notice of site visit which must remain posted for 30 days.

    101223 (a) (1) (3) Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, …….or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting……. This requirement was not met as evidenced by: LPA Clayton's observation of the staff forcing the children to sleep and forcing the children to wake up from their nap which poses a Health and Safety Risk to children in care.

    101230 Activities (a) Each center shall provide a variety of daily activities designed to meet the needs of children in care, including but not limited to: (4) Toileting. This requirement was not met as evidenced by: LPA Clayton's observation that the children in the Dolphin class are not having their toileting/diapering needs addressed until a another teacher arrives at 10am, which posed a Health and Safety risk to children in care.

This requirement was not met as evidenced by: The child in care suffered a dislocated elbow in care, and LPA Clayton's observation of teacher S1 pulling children by the wrist, and arm, which poses and immediate Health and Safety risk to children in care.

    (7) Modified diets prescribed by a child's physician as a medical necessity shall be provided. (B) A child shall not be served any food to which the child's record indicates he/she has an allergy. This requirement was not met as evidenced by: Director's acknowledgement that on at least one occsasion, the child in care was served food indicated in her file as an allergen, which posed an immediate Health and Safety risk to children in care.
