What the inspector wrote

On 02/06/2025, Devon Carus & Adrian Risher Licensing Program Analysts (LPAs) conducted a case management deficiencies visit. LPAs observed 4 children in care at the time of the inspection.. During an inspection by Investigator Veronica Padilla of the Department’s Investigation Bureau. A child in care was observed outdoors playing with wet socks. Investigator Padilla informed the provider of her observations and provider removed the wet socks from child. This is an immediate health & safety risk for children in care & a TYPE A Personal Rights violation. Please see type “A” deficiency on the LIC 809-D Upon receipt of this report, the Licensee shall post the Notice of Site Visit (LIC 9213) and any Licensing report documenting a type “A” deficiency. The report and the Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement of Receipt (LIC 9224) form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224). Exit interview was conducted and a copy of the report was provided. Appeal rights were reviewed and provided.

This requirement was not met as evidenced by: A child sustained a fractured leg when the licensee did not carefully place the child in a crib. Licensee did not check on child timely to render aid. Licensee did not utilize age-appropriate napping equipment for the child. This is an immeditate health & safety risk for children in care.

    1024117 (a) Operation of a Family Childcare Home (a) The licensee shall be present in the home and shall ensure that children in care are supervised at all times…. This requirement was not as evidenced by: A child sustained a fractured leg when licensee did not use care on placing a child in a crib for a nap.Based on the child’s age the crib was not age-appropriate which is a personal rights violation and led to lack of supervision when licensee did not check on child timely to ensure child was free from pain. This is a health & safety risk for children in care.
