What the inspector wrote

On March 09,, 2022, Licensing Program Analyst (LPA) Isabel Ortega conducted an unannounced complaint inspection on the above allegation. LPA disclosed the purpose of inspection and was granted entry by Assistant who guided LPA on a tour of the family child care home. During initial entry, Licensee was not present at the facility and 6 children were present. Licensee was conducting child pick ups and arrived at about 4.00 P.M. Licensee disclosed to LPA of 2 positive Covid-19 cases passing the required reporting requirements. Also licensee did not report additional positive covid results on different occasions to parents and CCL. Based on observations, interviews conducted and documentation obtained, allegation:Licensee did not inform appropriate parties of positive COVID-19 cases, the preponderance of evidence standard has been met, therefore the above allegation is found Substantiated. California Code of Regulations, Title 22, Division 12 Reporting Requirements Operation of a Family Child Care Home Type B violation is being cited. An exit interview was conducted, a copy of this Report, Appeal Rights, and Notice of Site Visit was provided to Licensee.

    (a) The licensee shall report the following information the Department by telephone or fax within the Department's next business day and during normal working hours (8am to 5pm).(b) The licensee shall report to the Department any of the events as specified in Health and ... Safety Code Sections 1597.467(b)(1)(A) through (b)(1)(C) that occur during the operation of the family child care home. This requirement was not met by interviews conducted and documentation(child##2 positive results) and disclosures. This posses a potential risk to children in care.

  • PERSONAL RIGHTS

    (a) Each child receiving services shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning this requirement was not met by interview disclosures. licensee is restraining children on high chairs and using off limits room to punish children when not wanting to nap or not listening. This poses an immediate risk to children in care.

  • STAFFING RATIO AND CAPACITY

    Staffing Ratio and CapacityThe capacity specified on the license shall be the maximum number of children for whom care may be provided at any one time. This requirement is not met as evidenced by:In the month of Jan.22 R&R subsidy Child care time sheets(CCRC) reflect licensee was caring for a total of 17 children at one time(2pm4pm) Monday - Friday, this is above the amount specified on the license. According to the current roster provided Licensee has 23 children enrolled. This is a type A deficiency that poses an immediate health and safe risk to children.

    (a) Personnel records shall be maintained on each employee and shall contain the following information: (10) A signed and dated copy of the Notice of Employee Rights [LIC 9052, (Rev. 03/03)] as required by Section 102416(a) and Section 102417.This requirement is not met as evidenced by: Based on record review the licensee did not comply with the section cited above Employee Cox disclosed she does not have mandated reported training, CPR/First aid, Driver's license, auto insurance and is providing pick ups and supervision which poses/posed a potential health, safety or personal rights risk to persons in care.

    (1) Pacifiers shall be allowed in the crib or play yard if the following provisions are in place:(A) There shall not be anything attached to the pacifier.This requirement was not met by: During walk through LPA observed an infant Child#1 sleeping in a play yard with a pacifier attached to a stuffed animal, blanket, and stuffed animal toy in the play yard.This poses an immediate health and safety risk to children in care.

    (1) The provider shall physically check on the infant every 15 minutes. (D) Documentation shall be maintained in the infant’s file and be available to the Department for review. (5) If the infant is sleeping in a separate room from where the provider is stationed, the door to the room the infant is sleeping in shall remain open... at all times. (A) The provider shall be able to visually observe the infant without moving the door. This requirement was not met by:LPA observed children in a separate room with the door closed. Not visual observation was completed and no 15 min checks were observed. This possess an immediate risk to children in care.
