PERSONAL RIGHTS
Based on observation, interview, record review, the licensee did not comply with the section cited above in which poses/posed a potential health, safety or personal rights risk to persons in care. LPA Garcia observed a 17 month old infant in care to be sleeping on a cot with a bean bag placed on her back, while infant was sleeping on stomach. LPA informed the licensee bean bag must be removed immediately. Licensee stated, the child's mom insists on infant sleeping that way because whe will not sleep otherwise. Licensee stated she is aware of safe sleep regulations.

(2)To receive safe, healthful, and comfortable accommodations... This requirement was not met by LPA’s review of records and statements disclosed that the licensee placed a weighted vest and ankle weights on Child #1 for 1 to 2 minutes to calm the child. This resulted in the child not being provided a comfortable environment. This is a Type B citation.

LPA observed one infant(1) in a playpen sleeping with a pillow, infant lounger with bumper padding and a blue weighted sensory compressor on Infant #1's mid body while napping. This poses an immediate risk to the health and safety to children in care.
