Inspector’s narrative

What the inspector wrote

on the carpet and watched the activity that was going on at that time in the auditorium. Per staff#7, child#1 was unsupervised from the time that children were lined to come back to the preschool classroom and child#1 was found while still children were on school age middle enclosed yard. Based on an interview that was conducted with complainant, child#1 was found unsupervised in auditorium by staff #7 on 11/14/24, when Rams visited the school. LPA counted approximately 50 foot steps from where staff#7 found out child#1 was missing, it was between school age middle enclosed yard between the middle tree and gate toward the grass yard, and where child#1 was found inside the auditorium on the carpet. Pictures were taken. Based on LPA observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated at this time. California Code of Regulations, 101229(a) (1)-- Responsibility for Providing Care and Supervision--(a)The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation and 101223(a)(2) is being cited on the attached LIC9099D. LPA Anomeh Eivazian informed Site Supervisor, Perla Leyvas that this report dated 02/28/25 documents 1 Type A citation. Type A citation which shall be posted for 30 consecutive days as there is immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Eivazian informed the licensee to provide a copy of this licensing report dated 02/28/25 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. The notice of site visit was posted where the parent/guardian of children enter and exit the facility. This notice shall remain posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty. Exit interview was conducted with Program Supervisor, Perla Leyvas. REPORT END 2 of 2 classroom bathroom door open in a way to have eye on the children who needed to wash hands. Per staff#5, if new arrival children needed to use bathroom staff#5 would ask the child parent to assist the child with bathroom as far as staff#5 could not see the toilet in the bathroom from door frame. Per staff#3 and staff#6 they did not observe staff#5 to leave the children unsupervised in lunch table on 12/20/24 from 8:00-8:30 AM when staff#8 was on break. Per staff#3, she went to bring food from cafeteria and per staff#6, at that time she was in school front office. Per staff#1 interview, at 2:30 PM when classrooms come together, she barely has 20 children at one time, mostly 15- 18 children and always staff#1 is present with two teacher assistants. Per staff #1, she never been alone with children after 2:30 PM. Based on staff interviews, they did not observe a staff to change a child's diaper on the children table. Per staff#4, staff#8 brought to her attention that a staff member changed a child's soiled diaper on the children table. Per staff#4, when she followed up with staff#2 she did not observe it. The allegations may have happened or are valid, but there is not a preponderance of evidence to prove the alleged violations occurred, therefore the allegations are unsubstantiated at this time. The evidence scale is equal meaning the weight of convincing evidence to prove something happened is equal to and has just as much convincing weight that it did not happen. The Notice of Site Visit (LIC 9213) was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Program Supervisor, Perla Leyvas. REPORT END 2 of 2
