What the inspector wrote

On 04/23/26 at 12:45pm, Licensing Program Analyst (LPA) Diana Ortiz conducted an unannounced Case Management-Incident Report visit. LPA met with Director Susan Stubbs who guided LPA on a tour of the facility. LPA observed 85 children and six (6) staff present during this visit. The department received an unusual incident report on 04/14/26 via email for an incident that occurred on 04/13/26. Per Title 22 Regulations the report was reported in a timely manner. During today’s visit, LPA conducted interviews with Director, and two (2) staff. LPA observed the classroom where the incident occurred. LPA toured the facility. Director explained that the incident occurred in the afternoon. An in-house incident report was completed, and parents of all involved children were notified. Per Director, Child #1 (C#1)s parents were informed on the day of the incident. C#1’s parent acknowledged the report. Child #2 (C#2) father expressed concern about the severity of the bite and requested information about the other child’s family, which was not provided. He later reported seeking medical care for C#2 and claimed she was prescribed antibiotics, though no documentation was submitted. C#2 was withdrawn from the program the following day. Staff #1 (S#1) and Staff #2 (S#2) provided consistent accounts that the incident occurred in the classroom kitchen play area. C#2 repeatedly attempted to take a toy (spatula) from C#1. Staff redirected C#2 multiple times and C#1 verbally told her to stop. C#2 continued to approach and ultimately took the toy from C#1, at which point C#1 bit her. S#1 and S#2, who both directly observed the incident, immediately separated the children. C#1 was told that biting is not acceptable. C#2 was assessed; the bite resulted in redness and a visible mark but no broken skin, bleeding, or swelling. First aid was provided in the form of an ice pack, after which C#2 calmed down and pictures were taken as well. Page 1 of 2 After interviews, observation of the areas and documentation of the injury, it was determined that staff were unable to prevent the injury from happening; therefore, there is no preponderance of evidence to determine that a regulatory violation occurred, the incident was determined to be an accident. No deficiencies or civil penalties are being cited at this time. Exit interview conducted and report reviewed with Director, Susan Stubbs. A notice of site visit was provided, and appeal rights were provided and discussed. Page 2 of 2
