What the inspector wrote

Page 2 Personal Rights: Day care children were exposed to hazardous materials. RP (Reporting Party) states a child was covered in red paint from a slide and RP attempted to remove the substance with soap, water, wipes, and rubbing alcohol but was unable to fully remove it. RP stated on 03/03/26, Director stated several children had the substance on their hands and that hand sanitizer removed it for some but not others. RP stated the director was unable to identify what product was used. RP expressed concern that children were allowed to use the slide while paint was still wet and that no sign was posted. Per interviews with staff there was one child who said the paint came off her hands, another child had red paint on their bottom and another child had paint on their shoe. Staff ended up putting yellow caution tape to block the slide and after laced black electrical tape to cover the bottom red portion of the slide. Director states she was not a wear of the slide being painted over the weekend to prevent the children from using it and was not told if the paint was toxic or non-toxic. Buildings and Grounds : Staff did not ensure that the facility was free of hazards. RP (Reporting Party) states the entry gate has been left unlocked in the mornings. Per interviews and observations the gates were cited by the fire department on 02/12/2026 to have the latches removed and panic hardware installed. The latches have been removed per the fire department request so they are unlocked during the day care days and hours, however no panic alarm has been installed as of this date per the fire department request. Buildings and Grounds: Staff did not provide day care children with a safe environment. RP states uneven asphalt in the outdoor play area despite recent crack seal application, creating potential tripping hazards. Per LPA observation the facility has already begane to fill in the cracks on the asphalt in the school age outdoor play area and are continuing to work on preventions of a child getting hurt. Based on LPA observations and interviews which were conducted and records received and reviewed, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 & Chapter 1, are being cited on the attached LIC 9099D page. Deficiencies that are being cited need to be cleared to protect the children’s health & safety. Page 3 A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100 Exit interview conducted and report was reviewed with Director Brenda Garcia. LPA, Cynthia Reyes informed Director Brenda, that this report dated 03/11/2026 document(s) (2) Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety or personal rights of a child in care. Also, LPA, Reyes informed Licensee, to provide a copy of this licensing report dated 03/11/2026 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC9224), or written statement, must be placed in the child’s file for verification

This requirement is not met as evidenced by: A swing chain separated from the shackle, causing the child to fall and hurt her knee and day care children were exposed to hazardous materials. A slide was painted with unknown toxic or non toxic paint and children used the slide and got paint on their clothes shoes and hands. This poses an immediate health and safety risk to children in care.

    Buildings and Grounds: The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors This requirement is not met as evidenced by: The fire department requested to have the latches on the front gate doors removed and open during day care days and hours and panic hardware installed, however no panic hardware have been installed as of this date. Also there is uneven asphalt in the outdoor play area. This poses an immediate health and safety risk to children in care.
