What the inspector wrote

The complaint alleges a staff member at the facility is mean and yells. During interviews conducted, parents stated they are happy with the care and supervision their children receive at the facility and parents stated their children enjoy attending the child care facility. Children interviewed stated they like the staff at the facility and did not disclose that any staff have yelled or are mean. Licensee and staff interviewed stated that staff do not yell and are not mean to children in care. During visits to the facility on 11/7/24, 11/21/24, 12/12/24, 1/22/25, and 1/24/25, LPA did not observe staff yell or be unkind to children in care. Allegation #2: Licensee is not preventing day care child(ren) from harming other day care child(ren) while in care. According to the complaint a child in care was injured by another child in care and sustained a large gash on the forehead. The complaint also states children in care have received multiple bruises from being kicked and bitten by other children while in care and staff do not try to prevent the injuries. During interviews, parents stated they were happy with the care and supervision provided to their children and their children have not had any issues with injuries while in care. Licensee and staff interviewed stated that when they know a child is prone to biting, they keep an extra close eye on the child in an attempt to prevent children from being bitten while in care. Licensee and staff stated there have been no children with a large gash on their forehead but that the facility did have one child sustain a scrape on their forehead the size of a marker dot. Allegation #3: Licensee does not ensure that day care child(ren)'s diapering needs are being met while in care. Complaint alleges a child in care has had a severe diaper rash resulting from neglect from the staff at the childcare. During interviews conducted the Licensee and staff stated they change the children\342\200\231s diapers every 2 hours or earlier if they notice a child\342\200\231s diaper needs changing and deny that a child in care has ever had a diaper rash resulting from neglect of the facility. Parents interviewed stated their children did not have any issues with diaper rashes or toileting while at the facility. Page 2 of 3 Allegation #4: Day care children are sustaining unexplained injuries while in care. According to the complaint children in care have received unexplained bruises on the upper thigh, ankles, and hand. During interviews staff stated they have no knowledge of children having any unexplained bruising. Licensee stated, "Abnormal bruising no, They have bruises on their shins from falling off the bikes or bumping into things, or bumping into each other". Parents interviewed stated their children did not have any issues with any injuries while in care and are happy with the care and supervision being provided to their children. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated. There were no deficiencies cited on the above-mentioned allegations per California Code of Regulations Title 22. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with Licensee, Laura Diaz. Page 3 of 3
