Staffing Ratio and Capacity 102416.5(e) If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home...This requirement was not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above as assistant was left alone at the facility caring for 7 children, which poses an immediate health, safety or personal rights risk to persons in care.

OPERATION OF A FAMILY CHILD CARE HOME

102417(b) The home shall be kept clean and orderly...This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above as LPA & Investigator observed a kitchen sink full of dirty dishes and pans, counter and table have food remnants on them, stove top with remnants of dried food and dirty pans, stove top control panel with grease splatter, kitchen floor has debris, and multipe baseboards removed, which poses a potential health, safety or personal rights risk to persons in care.

1024179(g)(8) Each family child care home shall have a current roster of children...This requirement is not met as evidenced by: Based on record review the licensee did not comply with the section cited above as licensee does not have a current roster which poses an potential health, safety or personal rights risk to persons in care.

INFANT SAFE SLEEP

Infant Safe Sleep 102425(i) If an infant falls asleep before being placed in a crib or play yard, the provider shall move the infant to a crib or play yard...This requirement was not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above as infant was observed asleep in a wooden rocker with a blanket covering them and a bottle propped on the blanket, which poses an immediate health, safety or personal rights risk to persons in care.

ARTICLE 2. Administration of Child Day Care Licensing

1596.8662(b)(1)...employee of a licensed child day care facility shall complete the mandated reporter training...This requirement is not met as evidenced by: Based on record review, Staff #2 does not have proof of current mandated reporter training which poses a potential health, safety or personal rights risk to persons in care.

Family Day Care Homes

1597.622(c) The family day care home shall maintain documentation of the required immunizations... in the person’s personnel record that is maintained by the family day care home.This requirement is not met as evidenced by: Based on interview and record review the licensee did not comply with the section cited above as licensee does not have proof of measles, pertussis or influenza immunizations for Staff #2 which poses a potential health, safety or personal rights risk to persons in care.

OPERATION OF A FAMILY CHILD CARE HOME

Based on observation, the licensee did not comply with the section cited above in 1 out of 1 homes with a kitchen sink full of dirty dishes and pans, stove top with multiple remnants of dried food and dirty pan, stove top control panel coated in grease, inside of the toilet bowl in the children's bathroom had a black ring, cob webs in the living room, baseboard in kitchen is laying on floor, which poses/posed a potential health, safety or personal rights risk to persons in care.

Availability of information regarding detecting and reporting child abuse and neglect; training for mandated reporter ...proof of completion.(4)The department shall...(b)(1)On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child care provider...or employee...shall complete renewal mandated reporter training every two years... (end of regulation)This requirement is not met as evidenced by Licensee and Licensee's brother/Assistant did not renew their training, both expiring 4/3/2020. This is a potential health and safety risk to children in care.
