What the inspector wrote

Page 2 It was determined through interviews with staff that the younger child had fallen asleep in the back of the bus and staff did not do their safety sweep of the bus, so the child was left inside the bus alone while the other children went inside the school to their classroom. RP and staff stated it is unknown how long the child was left in the vehicle. Per interviews and documents the child could have been left in the bus for about 30 minutes the earliest time to an hour the longest. Per interviews with staff, children, and the police, it was determined that the child was left on the facility bus, during a hot day alone for a period of time. Per Interviews with staff #1, #2 and #3, all three admitted that they did lie to the police and to the licensing department regrading the actual story of what happened regarding the child being left on the bus and the staff not doing the normal safety sweep of the van to ensure no one or nothing was left behind. Based on Licensing staff observations, interviews conducted, record review and the police investigation report, there are Deficiencies being cited on this date. The following deficiency listed on the attached LIC 9099-D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiency that are being cited needs to be cleared to protect the children’s health & safety. LPA provided consultation during this inspection. Exit interview conducted and report was reviewed with Florence Banda, Director. A notice of site visit was given and must remain posted for 30 days. LPA, Cynthia Reyes informed Florence Banda, Director, that this report dated 10/16/2025 document(s) (3) Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety or personal rights of a child in care. Also, LPA, Reyes informed Director, to provide a copy of this licensing report dated 10/16/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC9224), or written statement, must be placed in the child’s file for verification.

    Responsibility for providing Care and supervision: (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.The requirement is not met as evidenced by: A child was left alone in the school van due to staff not doing the normal safety sweep of the van to ensure no one or nothing was left behind. This poses an immediate health and safety risk for children in care.
