What the inspector wrote

On 6/1/2022 at 8:55 AM, Licensing Program Analyst (LPA) Carolyn Tuba and Licensing Program Manager, Claudia Guangorena conducted an unannounced inspection. Risk Assessment of Covid was conducted and proper PPE was used. LPA and LPM met with Administrators, Filmeena Amjad and Nilmini Weerasekara was given a tour of classrooms 2, 3, 4 and a census of 58 children with 6 staff were observed, as well as a tour of the play yard was conducted. During the visit the following was observed; during check-in the soles of the children's shoes were being sprayed with Lysol and a water solution onto a rubber mat that has a wash cloth on it. Administrator, Nilmini stated that the spraying is to avoid children bringing germs into the facility and causing cross contamination. She stated that has been done for 2 years since Covid-19 began and the Director, Harvinderpal Vaghel instructed staff to administer this practice. Administrator, Nilmini provided the bottle of Lysol at the LPA's request. Licensing staff observed that the Lysol bottle clearly states that the solution should be used on surfaces and the Precautionary Statement on the bottle states "Hazardous to Humans and Domestic Animals." After observations and conducting interviews with Administrators, Filmeena Amjad and Nilmini Weerasekara, they both stated that parents wait outside and are not allowed to come in for both drop-off and pick-up. They stated the reason is due to Covid-19. This was observed by licensing staff. Report continued on page 2. Parent's make note of the children's temperature as preschool staff take the child's temperature. Parent's have to wait outside for their turn to sign their child in to the preschool. This is against the Parent's Right to come into the facility to observe the child's classroom and the areas the children have access to. Parent's should be allowed to enter the preschool as long as they follow COVID protocols set-up by the director, such as wearing face masks, bringing their own writing instrument (pen or pencil) to log child's temperature and having their temperature taken before dropping child off in classroom. Upon speaking to the licensee over the phone, Mr. Hissanka Gunasekara stated that the Department of Health commended him for taking the safety precautions to keep children safe of not letting the parent's into the facility. Licensing staff explained to licensee that he could keep the protocols he had in place, but parent's needed to be allowed to enter the facility to drop-off their children, since it is part of their parent's rights. Licensing staff also explained the regulations regarding Personal Rights and Parent's Rights did not change with the pandemic. The following deficiencies are being cited based on observations during visit. Per Title 22, Division 12, Chapter 3 of the California Code of Regulations, the following deficiencies are being cited: (see next page, 809 D) Appeal rights were issued and discussed. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Administrator, Nilmini Weerasekara

Based on observation, the licensee did not comply with the section cited above in soles children's shoes were being sprayed with Lycol and water solution which poses a potential health, safety or personal rights risk to persons in care, since the lycol is not to be used in that way.
