What the inspector wrote

Time sheets for staff were also provided for teachers in classrooms #2, #3, #6 and #7 as well as other staff working at the facility. Interviews conducted and a review of the mentioned records found a preponderance of evidence, which included multiple corroborating statements, that on several occasions staff is left alone with up to 26 children. Though dates and length of times varied, this investigation found that teacher/child ratios have been an ongoing issue during breaks, when staff calls in due to appointments, when staff is not in their assigned rooms, and when staff leaves early or comes in late. On 07/14/21 at 2:36pm , LPA and Director observed 18 children napping, one child sitting on a chair at a desk, and another child walking around the classroom with one staff present. Based on interviews conducted, records reviewed, and observation the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiency are being cited (see attached 9099D). Limitations on Capacity - Complainant alleged that school age children are allowed to attend the daycare. During the course of the investigation and subsequent visit, licensing staff conducted interviews, obtained and reviewed staff transcripts, and classroom rosters for Rooms #2, #3, #6, and #7. According to Director, staffs’ own school age children are allowed to attend the center. However, children only have access to off limits areas. Interviews conducted found that there were conflicting statements pertaining to areas accessible to school age children. Per Director, due to COVID-19 pandemic, children are attending school via Zoom. On 7/14/21 at 2:28pm, LPA and LPM observed seven children sitting in the hallway. Of the seven children observed in the hallway, three of the children were identified as school age children (age 7) and are enrolled and attending a public school age program during the academic school year. Based on interviews conducted and observation, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiency are being cited (see attached 9099D). Upon receipt, the Licensee shall post the “D” page of the Licensing report. This page shall be posted for 30 consecutive days. Failure to maintain posting as required will result in a $100 civil penalty. A copy of this report shall be provided to the parents/guardians of the children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parents/guardians of any children newly enrolled at the facility for the next 12 months. The LIC 9224 Acknowledgement of Receipt of Licensing Reports must be maintained in each child's file immediately upon receipt from the parent. LPA provided Licensee with a blank copy of the LIC 9224 Acknowledgement of Receipt of Licensing Report. Exit interview was conducted with Director, Gina Wilson, who was provided with a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these forms.
