Licensing Program Analyst (LPA) Mireya Garc\303\255a conducted an unannounced Case Management inspection due to an incidents that were reported to the Department on August 11, 2022, April 03, 2023 & April 11, 2023. LPA met Teacher Aleyda Carranza who guided LPA on a tour of the facility, Pincipal Jorge Reyes was not present during this inspection. Census was taken. The purpose of this report is to address the investigative findings of the unusual incident reports that were reported to the Department. On 08/11/2022, an incident was self reported to the Department via telephone by the facility who reported a parent alleges that a child's personal rights were violated while in care by Staff #1. During the inspection conducted on June 06, 2023, LPA Garcia conducted interviews with Principal, five (5) staff and three (3) day care children. During the course of the investigation, LPA Garcia obtained a copy of the LIC 9040 Children's roster dated 06/06/23, two (2) Staff signed written statements dated 08/14/22 & 04/14/23 and conducted interviews with six (6) staff, five (5) day care children and attempt to interview child #1 & Parent #1. All interviews conducted with Staff deny observing any staff hit any child in care. Staff #1 denies allegation. No disclosures were made by all five (5) children interviewed. LPA attempted to interview Child #1 however, child is no longer enrolled at the facility since August 11, 2022 and parent of child #1 refuse interview. Based on the interviews conducted, at this time there is not enough evidence to support that child #1\342\200\231s personal rights were violated while in care. REPORT CONTINUES ON NEXT PAGE 1 OF 3. This agency has investigated the incident that alleges that child\342\200\231s #1 personal rights were violated while in care. Although the allegation may have happened or is valid; Based on interviews conducted with six (6) day care staff and five (5) day care children it was determined there were no witnesses to any children being hit while in care. Parent of child #1 refused to allow interview of child #1, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore at this time the allegation is deemed Unsubstantiated. Should additional information become available in the future, this investigation may be reopened. Pertaining to the incident that was self reported on April 3, 2023, to the Department via email by the facility who reported a staff alleges that a child disclosed that the child's personal rights were violated by Staff #1 while in care. During the course of the investigation, LPA Garcia interview five (5) staff, child in question, four (4) other day care children and several attempts were made to interview parent of child in questioned via telephone. Interview with all five (5) staff deny observing child #2 and/or any child in care being scratch by staff. Staff #1 denies allegation. Child in questioned and four (4) other children interviewed made no disclosures. Based on the interviews conducted, at this time there is not enough evidence to support that the child #2\342\200\231s personal rights were violated while in care. This agency has investigated the incident that alleges that child\342\200\231s #2 personal rights were violated while in care. Although the allegation may have happened or is valid; Based on interviews conducted; there were no disclosures and no witness to the allegation, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore at this time the allegation is deemed Unsubstantiated. Should additional information become available in the future, this investigation may be reopened. REPORT CONTINUES ON NEXT PAGE 2 OF 3. Referring to the incident that was self reported on April 11, 2023, to the Department via email by the facility who reported a parent alleges that child's personal rights were violated while in care. During the course of the investigation, LPA Garcia conducted in person interviews with three (3) staff, child in question, two (2) other day care children and telephone interview with parent of child in questioned. Interview with (2) witness staff deny Staff #2 speaking to child #3 in an inappropriate tone. Staff #2 denies allegation. Child in questioned and two (2) other children interviewed made no disclosures. Interview with the parent of child in questioned reveal that parent has no concerns regarding Staff #2 and disclosed observing Staff #2 being kind to child #3. Based on the interviews conducted, at this time there is not enough evidence to support that the child\342\200\231s personal rights were violated while in care. This agency has investigated the incident that alleges that child #3\342\200\231s personal rights were violated while in care. Although the allegation may had happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore at this time the above allegation is deemed unsubstantiated. Should additional information become available in the future, this investigation may be reopened. A notice of site visit was given and must remain posted for 30 days.
