What the inspector wrote

Licensing Program Analyst (LPA) Saul Valenzuela conducted an unannounced Case Management inspection due to 3 incidents that were reported to the Department on 1/03/2024, 6/14/2024 and 09/4/2024. LPA met with Principal Jorge Reyes who guided LPA on a tour of the facility. Census was taken. On January 3rd, 2024, one incident was reported to the Department via Email by the facility who reported a parent alleged that a child's personal rights were violated while in care. On June 14th, 2024, one incident was self reported to the Department via Email by the facility who reported that a child's personal rights were violated in care. On September 4th, 2024, one incident was self reported to the Department via Email by the facility who reported a parent alleged that a child's personal rights were violated in care. All reports were reported within the required 24 hours. The purpose of the inspection was to obtain additional information regarding the incidents reported to the Department. During the inspection, LPA Valenzuela conducted interviews with seven staff and three children. Regarding the three incidents disclosures were made on this date regarding personal rights violations. LPAs asked for copies of declarations, class roster, personnel roster , and investigation reports conducted by Principal- Principal provided copies of the documents to LPAs. -------------------------------------------------- pg. 1 of 2------------------------------------------------------------- Regarding incident that occurred on January 2 nd , 2024, child disclosed that staff grabbed them by the neck during nap time to lay them down. LPA was unable to interview Staff #1 (S1) as they were not available at the time of the visit. At the time of the incident Staff #2 (S2) was a substitute teacher and is currently assigned to another school within Los Angeles Unified School District. Child #1 (C1) transitioned out of the preschool program and was unavailable to be interviewed by LPA. LPA obtained declaration statements from staff that were present in the classroom that day. Statements conducted by Principal indicated that Staff #1 was not near C1 during nap time. Regarding incident that occurred on June 13 th , 2024, child stated that staff pulled them by the arm and hurt them. LPA interviewed Staff #3 (S3), Staff #4 (S4), and Staff #5 (S5), and no disclosures were made. LPA obtained declarations from S3, S4, and S5. Child #2 (C2) was interviewed and disclosed that Staff #4 pulled their arm. C2 demonstrated to LPA how S4 pulled their arm. C2 was unable to provide the name of staff, however C2 stated that the teacher is in Child #3 (C3) classroom. LPA verified that C4 is in S4 classroom via class roster and personnel roster. At the time of the incident, C4 was asked by Staff #8 to show them where the accident happened and C4 walked S8 outside and pointed to S4. Regarding incident that occurred on August 28th, 2024, parent notified staff that their child informed them that a staff in their classroom kicked them. LPA interviewed Staff #6 (S6), and Staff #7 (S7) and no disclosures were made. Child #4 disclosed that Staff Staff #6 kicked them when they were not listening. Child #4 (C4) demonstrated to LPA how S6 kicked C4 on the leg and stated that it hurt when it happened. Based on the LPA\342\200\231s observations and interviews, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children\342\200\231s health & safety. A notice of site visit was given and must remain posted for 30 days. C4 demonstrated to LPA how S6 kicked and stated that it hurt when the incident occurred, this poses/posed a potential health and safety risk to children in care.
