What the inspector wrote

Licensing Program Analyst (LPA) Roxana Lopez conducted an unannounced Case Management inspection due to 3 incidents that were reported to the Department on December 11 th , 2025 and 2 on February 6 th , 2026. LPA met with Principal Jorge Reyes who guided LPA on a tour of the facility. Census was taken. Per Principal there are 144 children enrolled. On December 11 th , 2025, one incident was reported to the Department via Email by the facility who reported that on December 5 th , 2025 a parent shared concerns of a staff member (Staff # 1- S1) rushing them out of the classrooms and preventing Child # 1 (C1) from going to them. On February 6 th , 2026 one incident was self reported to the Department via Email by the facility who reported that on January 30 th , 2026 child # 2 (C2) jumped off some wooden logs and fell on their arm- requiring medical attention. On February 6 th , 2026 one incident was self reported to the Department via Email by the facility who reported that on February 4 th , 2026 child # 3 (C3) fell and hit their head on the floor- an hour after they fell child began throwing up. LPA informed Principal that the first two incident reports were not reported within the required 24 hours. -------------------------------------------------- pg. 1 of 4 ---------------------------------------------------- The purpose of the inspection was to obtain additional information regarding the incidents reported to the Department. During the inspection, LPA Lopez conducted interviews with staff and children. LPAs obtained copies of class roster, personnel roster and outdoor assigned areas of supervision. Regarding incident that was reported on December 11 th , 2025, Staff # 1 disclosed that child # 1 was having a hard time saying good bye and that they told child # 1 they had to say goodbye because the class was about to transition- but was not preventing them from saying goodbye. Child # 1 did not make any disclosures about this incident- Per Child # 1 they don\342\200\231t like school but like their teachers even though they get mad because they don\342\200\231t listen. Regarding the first incident reported on February 6 th , 2026- Per Principal, the incident occurred outdoors on January 30 th , 2026. the fall resulted in a fracture and child # 2 was in a cast. Staff # 2 and 3 disclosed that child # 2 came crying to them and informed them that \342\200\234they had jumped and their arm was broken\342\200\235 Per Staff # 2 and 3 they did not observed the incident directly and were not aware of who observed the incident and that child # 2 only came to them after the fall, pointing to the area they fell. Per Staff # 4 they were not covering the area where the incident occurred and was informed of the incident the following day. Per staff # 2 they provided child # 2 ice and parents were called- child disclosed to staff that they were jumping off wooden logs in the manipulative area. During interview child disclosed that they were jumping off pretend wooden logs when they fell and \342\200\234broke my arm.\342\200\235 Per Child # 2 there was no teacher in that area and nobody help them up. Child # 2 disclosed that they were taken to the doctor and needed a cast. LPA obtained a copy of the outdoor assigned areas chart and schedule. Interviews with staff 1-4 disclosed that they remind children where it is safe to run and jump and that all areas on chart should be supervised when there\342\200\231s children present. Based on interviews conducted and documents reviewed the incident was not observed as no staff was supervising that area where child # 2 fell causing a fracture on their arm, this area is noted on the chart to be supervised- staff became aware of incident when child # 2 informed them of the fall. ------------------------------------------------- pg. 2 of 4---------------------------------------------------- Regarding the second incident reported on February 6 th , 2026- Per Principal the incident occurred outside in the grassy area, child # 3 fell and hit their head. Child was checked- no visible marks were noticed and parents were called, an hour later child # 3 was throwing up. Child # 3 was taken to the doctor and diagnosed with a mild concussion. Per Principal child # 3 was helped by staff # 5 (not available for interview). Per Staff # 2 they did not have details of incident and that child # 3 was helped by staff # 5. Per Staff # 3 the day of the incident they observed child # 3 crying by themselves on the \342\200\234edge\342\200\235 when they asked child # 3 what was wrong child # 3 disclosed that they had fell and their head hurting. Staff # 3 provided ice and checked child # 3 for injuries. Per staff # 3 when they informed Staff # 5, Staff # 5 shared that child # 3 had fallen earlier (an hour before) hitting their head and parents were informed. Per staff # 3, they were not aware of the fall and child # 3 continued saying their head was hurting and then began throwing up- Staff # 3 advised that parents should be called again and request for child to be picked up. During interview, Child # 3 disclosed that they were running and fell hitting their head on the floor. Child # 3 disclosed that ice was provided by staff # 3 after the incident. Per Principal, head injuries required a head injury form, injury report signed off by teacher- admin is informed and parents are called. Principal states that when head injuries occur all other staff are aware of incident. Interviews disclosed that they were not aware or did not have details of incident. Based on the LPA\342\200\231s observations, documentation reviewed and interviews, the two incidents reported on February 6 th , 2026 are an immediate risk for children in care. The following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children\342\200\231s health & safety. LPA Roxana Lopez informed facility representative Jorge Reyes that this report dated 3/3/2026 document(s) 1 Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Roxana Lopez informed facility representative to provide a copy of this licensing report dated 3/3/2026 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day ------- pg. 3 of 4 ------- or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. This requirement is not met as evidenced by Based on observation and interviews, the licensee did not comply with the section cited above in C2 fell causing a fractured arm in an area that was not supervised and not all staff was informed of C3 head injury for appropriate supervision.
